Stat. tit. 12A, § 12A-2-321","heading":"C.I.F. or C. and F.: \"Net Landed Weights\"; \"Payment on","body":"Arrival\"; Warranty of Condition on Arrival.\n\nUnder a contract containing a term C.I.F. or C. and F.\n\n(1) Where the price is based on or is to be adjusted according\n\nto \"net landed weights\", \"delivered weights\", \"out turn\" quantity or\n\nquality or the like, unless otherwise agreed the seller must\n\nreasonably estimate the price. The payment due on tender of the\n\ndocuments called for by the contract is the amount so estimated, but\n\nafter final adjustment of the price a settlement must be made with\n\ncommercial promptness.\n\n(2) An agreement described in subsection (1) or any warranty of\n\nquality or condition of the goods on arrival places upon the seller\n\nthe risk of ordinary deterioration, shrinkage and the like in\n\ntransportation but has no effect on the place or time of\n\nindentification to the contract for sale or delivery or on the\n\npassing of the risk of loss.\n\n(3) Unless otherwise agreed where the contract provides for\n\npayment on or after arrival of the goods the seller must before\n\npayment allow such preliminary inspection as is feasible; but if the\n\ngoods are lost delivery of the documents and payment are due when\n\nthe goods should have arrived.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"01a15cff09fd2799e651ba14eeb84ac325d1978c504ce4a43873fe74e4798ceb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2-320","next":"us-ok/okla.-stat.-tit.-12a-12a-2-322"},"notice":"GroundRules: Original legal text.
