Stat. tit. 12A, § 12A-2-323","heading":"Form of bill of lading required in overseas shipment -","body":"\"Overseas\".\n\nForm of Bill of Lading Required in Overseas Shipment;\n\n\"Overseas\".\n\n(1) Where the contract contemplates overseas shipment and\n\ncontains a term C.I.F. or C. and F. or F.O.B. vessel, the seller\n\nunless otherwise agreed must obtain a negotiable bill of lading\n\nstating that the goods have been loaded on board or, in the case of\n\na term C.I.F. or C. and F., received for shipment.\n\n(2) Where in a case within subsection (1) a tangible bill of\n\nlading has been issued in a set of parts, unless otherwise agreed if\n\nthe documents are not to be sent from abroad the buyer may demand\n\ntender of the full set; otherwise only one part of the bill of\n\nlading need be tendered. Even if the agreement expressly requires a\n\nfull set.\n\n(a) due tender of a single part is acceptable within the\n\nprovisions of this article on cure of improper delivery (subsection\n\n(1) of Section 2-508); and\n\n(b) even though the full set is demanded, if the documents are\n\nsent from abroad the person tendering an incomplete set may\n\nnevertheless require payment upon furnishing an indemnity which the\n\nbuyer in good faith deems adequate.\n\n(3) A shipment by water or by air or a contract contemplating\n\nsuch shipment is \"overseas\" insofar as by usage of trade or\n\nagreement it is subject to the commercial, financing or shipping\n\npractices characteristic of international deep water commerce.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d5ebb97f75e61cf563785f35b25d2db65db4de96d8f09bccecf6e4242c143198","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2-322","next":"us-ok/okla.-stat.-tit.-12a-12a-2-324"},"notice":"GroundRules: Original legal text.
