Stat. tit. 12A, § 12A-2-402","heading":"Rights of Seller's Creditors Against Sold Goods","body":"(1) Except as provided in subsections (2) and (3), rights of\n\nunsecured creditors of the seller with respect to goods which have\n\nbeen identified to a contract for sale are subject to the buyer's\n\nrights to recover the goods under this article (Sections 2-502 and\n\n2-716).\n\n(2) A creditor of the seller may treat a sale or an\n\nidentification of goods to a contract for sale as void if as against\n\nhim a retention of possession by the seller is fraudulent under any\n\nrule of law of the state where the goods are situated, except that\n\nretention of possession in good faith and current course of trade by\n\na merchant-seller for a commercially reasonable time after a sale or\n\nidentification is not fraudulent.\n\n(3) Nothing this article shall be deemed to impair the rights of\n\ncreditors of the seller.\n\n(a) under the provisions of the article on Secured\n\nTransactions (Article 9); or\n\n(b) where identification to the contract or delivery is\n\nmade not in current course of trade but in satisfaction of or as\n\nsecurity for a pre-existing claim for money, security or the like\n\nand is made under circumstances which under any rule of law of the\n\nstate where the goods are situated would apart from this article\n\nconstitute the transaction a fraudulent transfer or voidable\n\npreference.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"119d0feb6a71dbec1a2c5447cdb12c1b0908b27771e9c54dd26fa779e924b7ac","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2-401","next":"us-ok/okla.-stat.-tit.-12a-12a-2-403"},"notice":"GroundRules: Original legal text.
