Stat. tit. 12A, § 12A-2-509","heading":"Risk of loss in the absence of breach","body":"Risk of Loss in the Absence of Breach.\n\n(1) Where the contract requires or authorizes the seller to\n\nship the goods by carrier:\n\n(a) if it does not require him to deliver them at a particular\n\ndestination, the risk of loss passes to the buyer when the goods are\n\nduly delivered to the carrier even though the shipment is under\n\nreservation (Section 2-505); but\n\n(b) if it does require him to deliver them at a particular\n\ndestination and the goods are there duly tendered while in the\n\npossession of the carrier, the risk of loss passes to the buyer when\n\nthe goods are there duly so tendered as to enable the buyer to take\n\ndelivery.\n\n(2) Where the goods are held by a bailee to be delivered\n\nwithout being moved, the risk of loss passes to the buyer:\n\n(a) on his receipt of a negotiable document of title covering\n\nthe goods; or\n\n(b) on acknowledgment by the bailee of the buyer's right to\n\npossession of the goods; or\n\n(c) after his receipt of possession or control of a\n\nnonnegotiable document of title or other direction to deliver in a\n\nrecord, as provided in subsection (4) (b) of Section 2-503.\n\n(3) In any case not within subsection (1) or (2), the risk of\n\nloss passes to the buyer on his receipt of the goods if the seller\n\nis a merchant; otherwise the risk passes to the buyer on tender of\n\ndelivery.\n\n(4) The provisions of this section are subject to contrary\n\nagreement of the parties and to the provisions of this article on\n\nsale on approval (Section 2-327) and on effect of breach on risk of\n\nloss (Section 2-510).","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"80fc0b689619fe0aea851e0c6daf6db26a22ba7cc65ae548d9ab6b96d6fa2014","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2-508","next":"us-ok/okla.-stat.-tit.-12a-12a-2-510"},"notice":"GroundRules: Original legal text.
