Stat. tit. 12A, § 12A-2-616","heading":"Procedure on Notice Claiming Excuse","body":"(1) Where the buyer receives notification of a material or\n\nindefinite delay or an allocation justified under the preceding\n\nsection he may by written notification to the seller as to any\n\ndelivery concerned, and where the prospective deficiency\n\nsubstantially impairs the value of the whole contract under the\n\nprovisions of this article relating to breach of installment\n\ncontracts (Section 2-612), then also as to the whole,\n\n(a) terminate and thereby discharge any unexecuted portion\n\nof the contract; or\n\n(b) modify the contract by agreeing to take his available\n\nquota in substitution.\n\n(2) If after receipt of such notification from the seller the\n\nbuyer fails so to modify the contract within a reasonable time not\n\nexceeding thirty (30) days the contract lapses with respect to any\n\ndeliveries affected.\n\n(3) The provisions of this section may not be negated by\n\nagreement except in so far as the seller has assumed a greater\n\nobligation under the preceding section.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7125fed5b298ecf1d5525306f94814e12b7080740e2e87d5308017b7073a5ef1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2-615","next":"us-ok/okla.-stat.-tit.-12a-12a-2-701"},"notice":"GroundRules: Original legal text.
