Stat. tit. 12A, § 12A-2-705","heading":"Seller's stoppage of delivery in transit or otherwise","body":"Seller's Stoppage of Delivery in Transit or Otherwise.\n\n(1) The seller may stop delivery of goods in the possession of\n\na carrier or other bailee when he discovers the buyer to be\n\ninsolvent (Section 2-702) and may stop delivery of carload,\n\ntruckload, planeload or larger shipments of express or freight when\n\nthe buyer repudiates or fails to make a payment due before delivery\n\nor if for any other reason the seller has a right to withhold or\n\nreclaim the goods.\n\n(2) As against such buyer the seller may stop delivery until\n\n(a) receipt of the goods by the buyer; or\n\n(b) acknowledgement to the buyer by any bailee of the goods\n\nexcept a carrier that the bailee holds the goods for the buyer; or\n\n(c) such acknowledgment to the buyer by a carrier by reshipment\n\nor as a warehouse; or\n\n(d) negotiation to the buyer of any negotiable document of\n\ntitle covering the goods.\n\n(3) (a) To stop delivery the seller must so notify as to enable\n\nthe bailee by reasonable diligence to prevent delivery of the goods.\n\n(b) After such notification the bailee must hold and deliver\n\nthe goods according to the directions of the seller but the seller\n\nis liable to the bailee for any ensuing charges or damages.\n\n(c) If a negotiable document of title has been issued for goods\n\nthe bailee is not obliged to obey a notification to stop until\n\nsurrender of possession or control of the document.\n\n(d) A carrier who has issued a nonnegotiable bill of lading is\n\nnot obliged to obey a notification to stop received from a person\n\nother than the consignor.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"16eb2950a0e309441650e1d02d56cc04f3d51fa63f6d990bb3e991cfa8afc37e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2-704","next":"us-ok/okla.-stat.-tit.-12a-12a-2-706"},"notice":"GroundRules: Original legal text.
