Stat. tit. 12A, § 12A-2-708","heading":"Seller's Damages for Nonacceptance or Repudiation","body":"(1) Subject to subsection (2) and to the provisions of this\n\narticle with respect to proof of market price (Section 2-723), the\n\nmeasure of damages for nonacceptance or repudiation by the buyer is\n\nthe difference between the market price at the time and place for\n\ntender and the unpaid contract price together with any incidental\n\ndamages provided in this article (Section 2-710), but less expenses\n\nsaved in consequence of the buyer's breach.\n\n(2) If the measure of damages provided in subsection (1) is\n\ninadequate to put the seller in as good a position as performance\n\nwould have done then the measure of damages is the profit (including\n\nreasonable overhead) which the seller would have made from full\n\nperformance by the buyer, together with any incidental damages\n\nprovided in this article (Section 2-710), due allowance for costs\n\nreasonably incurred and due credit for payments or proceeds of\n\nresale.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"330eba81e4afaa8b070d1f276f0d8e306ca2b27e8366938d4d57318f56e50cab","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2-707","next":"us-ok/okla.-stat.-tit.-12a-12a-2-709"},"notice":"GroundRules: Original legal text.
