Stat. tit. 12A, § 12A-2-722","heading":"Who Can Sue Third Parties for Injury to Goods","body":"Where a third party so deals with goods which have been\n\nidentified to a contract for sale as to cause actionable injury to a\n\nparty to that contract\n\n(a) a right of action against the third party is in either\n\nparty to the contract for sale who has title to or a security\n\ninterest or a special property or an insurable interest in the\n\ngoods; and if the goods have been destroyed or converted a right of\n\naction is also in the party who either bore the risk of loss under\n\nthe contract for sale or has since the injury assumed that risk as\n\nagainst the other;\n\n(b) if at the time of the injury the party plaintiff did\n\nnot bear the risk of loss as against the other party to the contract\n\nfor sale and there is no arrangement between them for disposition of\n\nthe recovery, his suit or settlement is, subject to his own\n\ninterest, as a fiduciary for the other party to the contract;\n\n(c) either party may with the consent of the other sue for\n\nthe benefit of whom it may concern.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7f0d8db9e452eb82afdc9c5b1ebb68e42dc6a6a2007e52f74d2acded335edaaf","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2-721","next":"us-ok/okla.-stat.-tit.-12a-12a-2-723"},"notice":"GroundRules: Original legal text.
