Stat. tit. 12A, § 12A-2-723","heading":"Proof of Market Price: Time and Place","body":"(1) If an action based on anticipatory repudiation comes to\n\ntrial before the time for performance with respect to some or all of\n\nthe goods, any damages based on market price (Section 2-708 or\n\nSection 2-713) shall be determined according to the price of such\n\ngoods prevailing at the time when the aggrieved party learned of the\n\nrepudiation.\n\n(2) If evidence of a price prevailing at the times or places\n\ndescribed in this article is not readily available the price\n\nprevailing within any reasonable time before or after the time\n\ndescribed or at any other place which in commercial judgment or\n\nunder usage of trade would serve as a reasonable substitute for the\n\none described may be used, making any proper allowance for the cost\n\nof transporting the goods to or from such other place.\n\n(3) Evidence of a relevant price prevailing at a time or place\n\nother than the one described in this article offered by one party is\n\nnot admissible unless and until he has given the other party such\n\nnotice as the court finds sufficient to prevent unfair surprise.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"69ff2e17c98da70fbdb55190bd9abcb567075b2129091c304bcc9fc6885778d2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2-722","next":"us-ok/okla.-stat.-tit.-12a-12a-2-724"},"notice":"GroundRules: Original legal text.
