Stat. tit. 12A, § 12A-2A-208","heading":"Modification, rescission, and waiver","body":"MODIFICATION, RESCISSION, AND WAIVER\n\n(1) An agreement modifying a lease contract needs no\n\nconsideration to be binding.\n\n(2) A signed lease agreement that excludes modification or\n\nrescission except by a signed record may not be otherwise modified\n\nor rescinded, but, except as between merchants, such a requirement\n\non a form supplied by a merchant must be separately signed by the\n\nother party.\n\n(3) Although an attempt at modification or rescission does not\n\nsatisfy the requirements of subsection (2) of this section, it may\n\noperate as a waiver.\n\n(4) A party who has made a waiver affecting an executory\n\nportion of a lease contract may retract the waiver by reasonable\n\nnotification received by the other party that strict performance\n\nwill be required of any term waived, unless the retraction would be\n\nunjust in view of a material change of position in reliance on the\n\nwaiver.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"77009226b54ab01bbb47b54874ed5ba0da24c189ad1d2212fe3231ca11691050","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2a-206","next":"us-ok/okla.-stat.-tit.-12a-12a-2a-209"},"notice":"GroundRules: Original legal text.
