Stat. tit. 12A, § 12A-2A-209","heading":"Lessee Under Finance Lease as Beneficiary of Supply","body":"Contract.\n\nLESSEE UNDER FINANCE LEASE AS BENEFICIARY OF SUPPLY CONTRACT\n\n(1) The benefit of the supplier's promises to the lessor under\n\nthe supply contract and of all warranties, whether express or\n\nimplied, including those of any third party provided in connection\n\nwith or as part of the supply contract, extends to the lessee to the\n\nextent of the lessee's leasehold interest under a finance lease\n\nrelated to the supply contract, but is subject to the terms of the\n\nwarranty and of the supply contract and all defenses or claims\n\narising therefrom.\n\n(2) The extension of the benefit of a supplier's promises and\n\nof warranties to the lessee (subsection (1) of this section) does\n\nnot:\n\n(i) modify the rights and obligations of the parties to\n\nthe supply contract, whether arising therefrom or\n\notherwise, or\n\n(ii) impose any duty or liability under the supply contract\n\non the lessee.\n\n(3) Any modification or rescission of the supply contract by\n\nthe supplier and the lessor is effective between the supplier and\n\nthe lessee unless, before the modification or rescission, the\n\nsupplier has received notice that the lessee has entered into a\n\nfinance lease related to the supply contract. If the modification\n\nor rescission is effective between the supplier and the lessee, the\n\nlessor is deemed to have assumed, in addition to the obligations of\n\nthe lessor to the lessee under the lease contract, promises of the\n\nsupplier to the lessor and warranties that were so modified or\n\nrescinded as they existed and were available to the lessee before\n\nmodification or rescission.\n\n(4) In addition to the extension of the benefit of the\n\nsupplier's promises and of warranties to the lessee under subsection\n\n(1) of this section, the lessee retains all rights that the lessee\n\nmay have against the supplier which arise from an agreement between\n\nthe lessee and the supplier or under other law.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7366aa701ea74b3b8a8be53b4739c871a1d94586caf9940c2ddfc9d60a10e0eb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2a-208","next":"us-ok/okla.-stat.-tit.-12a-12a-2a-210"},"notice":"GroundRules: Original legal text.
