Stat. tit. 12A, § 12A-2A-212","heading":"Implied warranty of merchantability","body":"IMPLIED WARRANTY OF MERCHANTABILITY\n\n(1) Except in a finance lease, a warranty that the goods will\n\nbe merchantable is implied in a lease contract if the lessor is a\n\nmerchant with respect to goods of that kind.\n\n(2) Goods to be merchantable must be at least such as:\n\n(a) pass without objection in the trade under the\n\ndescription in the lease agreement;\n\n(b) in the case of fungible goods, are of fair\n\naverage quality within the description;\n\n(c) are fit for the ordinary purposes for which\n\ngoods of that type are used;\n\n(d) run, within the variation permitted by the lease\n\nagreement, of even kind, quality, and quantity within each unit and\n\namong all units involved;\n\n(e) are adequately contained, packaged, and labeled\n\nas the lease agreement may require; and\n\n(f) conform to any promises or affirmations of fact\n\nmade on the container or label.\n\n(3) Other implied warranties may arise from course of dealing\n\nor usage of trade.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e0f3fcdd7b6c64f64b11d4127c3605a42e578e699d568a9a2f1fcb566a4062ac","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2a-211","next":"us-ok/okla.-stat.-tit.-12a-12a-2a-213"},"notice":"GroundRules: Original legal text.
