Stat. tit. 12A, § 12A-2A-219","heading":"Risk of loss","body":"RISK OF LOSS\n\n(1) Except in the case of a finance lease, risk of loss is\n\nretained by the lessor and does not pass to the lessee. In the case\n\nof a finance lease, risk of loss passes to the lessee.\n\n(2) Subject to the provisions of this article on the effect of\n\ndefault on risk of loss (Section 29 of this act), if risk of loss is\n\nto pass to the lessee and the time of passage is not stated, the\n\nfollowing rules apply:\n\n(a) If the lease contract requires or authorizes the\n\ngoods to be shipped by carrier:\n\n(i) and it does not require delivery at a\n\nparticular destination, the risk of loss passes to the lessee when\n\nthe goods are duly delivered to the carrier; but\n\n(ii) if it does require delivery at a particular\n\ndestination and the goods are there duly tendered while in the\n\npossession of the carrier, the risk of loss passes to the lessee\n\nwhen the goods are there duly so tendered as to enable the lessee to\n\ntake delivery.\n\n(b) If the goods are held by a bailee to be\n\ndelivered without being moved, the risk of loss passes to the lessee\n\non acknowledgment by the bailee of the lessee's right to possession\n\nof the goods.\n\n(c) In any case not within paragraph (a) or (b) of\n\nthis subsection, the risk of loss passes to the lessee on the\n\nlessee's receipt of the goods if the lessor, or, in the case of a\n\nfinance lease, the supplier, is a merchant; otherwise the risk\n\npasses to the lessee on tender of delivery.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fd42f8700687d73fa7f53a5a439c19bd0749063445d6489dc9d82112d16c5115","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2a-218","next":"us-ok/okla.-stat.-tit.-12a-12a-2a-220"},"notice":"GroundRules: Original legal text.
