Stat. tit. 12A, § 12A-2A-304","heading":"Subsequent Lease of Goods by Lessor","body":"SUBSEQUENT LEASE OF GOODS BY LESSOR\n\n(1) Subject to Section 2A-303 of this title, a subsequent\n\nlessee from a lessor of goods under an existing lease contract\n\nobtains, to the extent of the leasehold interest transferred, the\n\nleasehold interest in the goods that the lessor had or had power to\n\ntransfer, and except as provided in subsection (2) of this section\n\nand subsection (4) of Section 2A-527 of this title, takes subject to\n\nthe existing lease contract. A lessor with voidable title has power\n\nto transfer a good leasehold interest to a good faith subsequent\n\nlessee for value, but only to the extent set forth in the preceding\n\nsentence. If goods have been delivered under a transaction of\n\npurchase, the lessor has that power even though:\n\n(a) the lessor's transferor was deceived as to the\n\nidentity of the lessor;\n\n(b) the delivery was in exchange for a check which is\n\nlater dishonored;\n\n(c) it was agreed that the transaction was to be a \"cash\n\nsale\"; or\n\n(d) the delivery was procured through fraud punishable as\n\nlarcenous under the criminal law.\n\n(2) A subsequent lessee in the ordinary course of business from\n\na lessor who is a merchant dealing in goods of that kind to whom the\n\ngoods were entrusted by the existing lessee of that lessor before\n\nthe interest of the subsequent lessee became enforceable against\n\nthat lessor obtains, to the extent of the leasehold interest\n\ntransferred, all of that lessor's and the existing lessee's rights\n\nto the goods, and takes free of the existing lease contract.\n\n(3) A subsequent lessee from the lessor of goods that are\n\nsubject to an existing lease contract and are covered by a\n\ncertificate of title issued under a statute of this state or of\n\nanother jurisdiction takes no greater rights than those provided\n\nboth by this section and by the certificate of title statute.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bf41a91057d87983e111f33f2de275e93b1abf49ec4ffcac9117ef807dfbd760","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2a-303","next":"us-ok/okla.-stat.-tit.-12a-12a-2a-305"},"notice":"GroundRules: Original legal text.
