Stat. tit. 12A, § 12A-2A-308","heading":"Special rights of creditors","body":"SPECIAL RIGHTS OF CREDITORS\n\n(1) A creditor of a lessor in possession of goods subject to a\n\nlease contract may treat the lease contract as void if as against\n\nthe creditor retention of possession by the lessor is fraudulent\n\nunder any statute or rule of law, but retention of possession in\n\ngood faith and current course of trade by the lessor for a\n\ncommercially reasonable time after the lease contract becomes\n\nenforceable is not fraudulent.\n\n(2) Nothing in this article impairs the rights of creditors of\n\na lessor if the lease contract:\n\n(a) becomes enforceable, not in current course of\n\ntrade but in satisfaction of or as security for a preexisting claim\n\nfor money, security, or the like, and\n\n(b) is made under circumstances which under any\n\nstatute or rule of law apart from this article would constitute the\n\ntransaction a fraudulent transfer or voidable preference.\n\n(3) A creditor of a seller may treat a sale or an\n\nidentification of goods to a contract for sale as void if as against\n\nthe creditor retention of possession by the seller is fraudulent\n\nunder any statute or rule of law, but retention of possession of the\n\ngoods pursuant to a lease contract entered into by the seller as\n\nlessee and the buyer as lessor in connection with the sale or\n\nidentification of the goods is not fraudulent if the buyer bought\n\nfor value and in good faith.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5fb57e78dfe103707633a47b045c36a488343e6c3571c0fab1cad048c60c0fff","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2a-307","next":"us-ok/okla.-stat.-tit.-12a-12a-2a-309"},"notice":"GroundRules: Original legal text.
