Stat. tit. 12A, § 12A-2A-402","heading":"Anticipatory repudiation","body":"ANTICIPATORY REPUDIATION\n\n(1) If either party repudiates a lease contract with respect to\n\na performance not yet due under the lease contract, the loss of\n\nwhich performance will substantially impair the value of the lease\n\ncontract to the other, the aggrieved party may:\n\n(a) for a commercially reasonable time, await\n\nretraction of repudiation and performance by the repudiating party;\n\n(b) make demand pursuant to Section 41 of this act\n\nand await assurance of future performance adequate under the\n\ncircumstances of the particular case; or\n\n(c) resort to any right or remedy upon default under\n\nthe lease contract or this article, even though the aggrieved party\n\nhas notified the repudiating party that the aggrieved party would\n\nawait the repudiating party's performance and assurance and has\n\nurged retraction.\n\n(2) In addition, whether or not the aggrieved party is\n\npursuing one of the remedies provided for in subsection (1) of this\n\nsection, the aggrieved party may suspend performance or, if the\n\naggrieved party is the lessor, proceed in accordance with the\n\nprovisions of this article on the lessor's right to identify goods\n\nto the lease contract notwithstanding default or to salvage\n\nunfinished goods (Section 71 of this act).","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d2c26225cf91eb9b7c6dd2ce0a6d219d4b4845b6ba33834295670c9d68840da0","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2a-401","next":"us-ok/okla.-stat.-tit.-12a-12a-2a-403"},"notice":"GroundRules: Original legal text.
