Stat. tit. 12A, § 12A-2A-405","heading":"Excused performance","body":"EXCUSED PERFORMANCE\n\nSubject to Section 44 of this act on substituted performance,\n\nthe following rules apply:\n\n(a) Delay in delivery or nondelivery in whole or in\n\npart by a lessor or a supplier who complies with paragraphs (b) and\n\n(c) of this section is not a default under the lease contract if\n\nperformance as agreed has been made impracticable by the occurrence\n\nof a contingency the nonoccurrence of which was a basic assumption\n\non which the lease contract was made or by compliance in good faith\n\nwith any applicable foreign or domestic governmental regulation or\n\norder, whether or not the regulation or order later proves to be\n\ninvalid.\n\n(b) If the causes mentioned in paragraph (a) of this\n\nsection affect only part of the lessor's or the supplier's capacity\n\nto perform, he shall allocate production and deliveries among his\n\ncustomers but at his option may include regular customers not then\n\nunder contract for sale or lease as well as his own requirements for\n\nfurther manufacture. He may so allocate in any manner that is fair\n\nand reasonable.\n\n(c) The lessor seasonably shall notify the lessee\n\nand in the case of a finance lease the supplier seasonably shall\n\nnotify the lessor and the lessee, if known, that there will be delay\n\nor nondelivery and, if allocation is required under paragraph (b) of\n\nthis section, of the estimated quota thus made available for the\n\nlessee.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"79a1f97ce870302182133c291583074b8c52806759925ae2c4da38f270b595df","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2a-404","next":"us-ok/okla.-stat.-tit.-12a-12a-2a-406"},"notice":"GroundRules: Original legal text.
