Stat. tit. 12A, § 12A-2A-506","heading":"Statute of limitations","body":"STATUTE OF LIMITATIONS\n\n(1) An action for default under a lease contract, including\n\nbreach of warranty or indemnity, must be commenced within four (4)\n\nyears after the cause of action accrued. By the original lease\n\ncontract the parties may reduce the period of limitation to not less\n\nthan one (1) year.\n\n(2) A cause of action for default accrues when the act or\n\nomission on which the default or breach of warranty is based is or\n\nshould have been discovered by the aggrieved party, or when the\n\ndefault occurs, whichever is later. A cause of action for indemnity\n\naccrues when the act or omission on which the claim for indemnity is\n\nbased is or should have been discovered by the indemnified party,\n\nwhichever is later.\n\n(3) If an action commenced within the time limited by\n\nsubsection (1) of this section is so terminated as to leave\n\navailable a remedy by another action for the same default or breach\n\nof warranty or indemnity, the other action may be commenced after\n\nthe expiration of the time limited and within six (6) months after\n\nthe termination of the first action unless the termination resulted\n\nfrom voluntary discontinuance or from dismissal for failure or\n\nneglect to prosecute.\n\n(4) This section does not alter the law on tolling of the\n\nstatute of limitations nor does it apply to causes of action that\n\nhave accrued before this article becomes effective.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1d66879787a137a8b3d223c56ce4a4a1c4a7d47815503c9bf1c5f15e227c971b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2a-505","next":"us-ok/okla.-stat.-tit.-12a-12a-2a-507"},"notice":"GroundRules: Original legal text.
