Stat. tit. 12A, § 12A-2A-528","heading":"Lessor's damages for nonacceptance, failure to pay,","body":"repudiation, or other default.\n\nLESSOR'S DAMAGES FOR NONACCEPTANCE, FAILURE TO PAY,\n\nREPUDIATION, OR OTHER DEFAULT\n\n(1) Except as otherwise provided with respect to damages\n\nliquidated in the lease agreement (Section 2A-504 of this title) or\n\notherwise determined pursuant to agreement of the parties\n\n(subsection (c) of Section 15 of this act and Section 2A-503 of this\n\ntitle), if a lessor elects to retain the goods or a lessor elects to\n\ndispose of the goods and the disposition is by lease agreement that\n\nfor any reason does not qualify for treatment under subsection (2)\n\nof Section 2A-527 of this title, or is by sale or otherwise, the\n\nlessor may recover from the lessee as damages for a default of the\n\ntype described in subsection (1) of Section 2A-523 or paragraph (a)\n\nof subsection (3) of Section 2A-523, or, if agreed, for other\n\ndefault of the lessee:\n\n(i) accrued and unpaid rent as of the date of default if\n\nthe lessee has never taken possession of the goods,\n\nor, if the lessee has taken possession of the goods,\n\nas of the date the lessor repossesses the goods or an\n\nearlier date on which the lessee makes a tender of the\n\ngoods to the lessor,\n\n(ii) the present value as of the date determined under\n\nclause (i) of this subsection of the total rent for\n\nthe then remaining lease term of the original lease\n\nagreement minus the present value as of the same date\n\nof the market rent at the place where the goods are\n\nlocated computed for the same lease term, and\n\n(iii) any incidental damages allowed under Section 2A-530 of\n\nthis title, less expenses saved in consequence of the\n\nlessee's default.\n\n(2) If the measure of damages provided in subsection (1) of\n\nthis section is inadequate to put a lessor in as good a position as\n\nperformance would have, the measure of damages is the present value\n\nof the profit, including reasonable overhead, the lessor would have\n\nmade from full performance by the lessee, together with any\n\nincidental damages allowed under Section 2A-530 of this title, due\n\nallowance for costs reasonably incurred and due credit for payments\n\nor proceeds of disposition.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9b9a77eb226c265ba235f2215e183cd37b9cb6faefd7773c9e161a47cf21eff4","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2a-527","next":"us-ok/okla.-stat.-tit.-12a-12a-2a-529"},"notice":"GroundRules: Original legal text.
