Stat. tit. 12A, § 12A-2A-531","heading":"Standing to sue third parties for injury to goods","body":"STANDING TO SUE THIRD PARTIES FOR INJURY TO GOODS\n\n(1) If a third party so deals with goods that have been\n\nidentified to a lease contract as to cause actionable injury to a\n\nparty to the lease contract:\n\n(a) the lessor has a right of action against the\n\nthird party, and\n\n(b) the lessee also has a right of action against\n\nthe third party if the lessee:\n\n(i) has a security interest in the goods;\n\n(ii) has an insurable interest in the goods; or\n\n(iii) bears the risk of loss under the lease\n\ncontract or has since the injury assumed that risk as against the\n\nlessor and the goods have been converted or destroyed.\n\n(2) If at the time of the injury the party plaintiff did not\n\nbear the risk of loss as against the other party to the lease\n\ncontract and there is no arrangement between them for disposition of\n\nthe recovery, his suit or settlement, subject to his own interest,\n\nis as a fiduciary for the other party to the lease contract.\n\n(3) Either party with the consent of the other may sue for the\n\nbenefit of whom it may concern.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"83208824f636ee4026dc74c954f8d02c405b573cedaf16230aadae63124e2ce8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2a-530","next":"us-ok/okla.-stat.-tit.-12a-12a-2a-532"},"notice":"GroundRules: Original legal text.
