Stat. tit. 12A, § 12A-3-304","heading":"Overdue Instrument","body":"OVERDUE INSTRUMENT\n\n(a) An instrument payable on demand becomes overdue at the\n\nearliest of the following times:\n\n(1) on the day after the day demand for payment is duly\n\nmade;\n\n(2) if the instrument is a check, ninety (90) days after\n\nits date; or\n\n(3) if the instrument is not a check, when the instrument\n\nhas been outstanding for a period of time after its\n\ndate which is unreasonably long under the\n\ncircumstances of the particular case in light of the\n\nnature of the instrument and usage of the trade.\n\n(b) With respect to an instrument payable at a definite time\n\nthe following rules apply:\n\n(1) If the principal is payable in installments and a due\n\ndate has not been accelerated, the instrument becomes\n\noverdue upon default under the instrument for\n\nnonpayment of an installment, and the instrument\n\nremains overdue until the default is cured;\n\n(2) If the principal is not payable in installments and\n\nthe due date has not been accelerated, the instrument\n\nbecomes overdue on the day after the due date; and\n\n(3) If a due date with respect to principal has been\n\naccelerated, the instrument becomes overdue on the day\n\nafter the accelerated due date.\n\n(c) Unless the due date of principal has been accelerated, an\n\ninstrument does not become overdue if there is default in payment of\n\ninterest but no default in payment of principal.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"04db867c408811d935759b30d01325d56460c521e280ddfbb7e8b697b176f935","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-3-303","next":"us-ok/okla.-stat.-tit.-12a-12a-3-305"},"notice":"GroundRules: Original legal text.
