Stat. tit. 12A, § 12A-3-308","heading":"Proof of Signatures and Status as Holder in Due Course","body":"PROOF OF SIGNATURES AND STATUS AS HOLDER IN DUE COURSE\n\n(a) In an action with respect to an instrument, the\n\nauthenticity of, and authority to make, each signature on the\n\ninstrument is admitted unless specifically denied in the pleadings.\n\nIf the validity of a signature is denied in the pleadings, the\n\nburden of establishing validity is on the person claiming validity,\n\nbut the signature is presumed to be authentic and authorized unless\n\nthe action is to enforce the liability of the purported signer and\n\nthe signer is dead or incompetent at the time of trial of the issue\n\nof validity of the signature. If an action to enforce the\n\ninstrument is brought against a person as the undisclosed principal\n\nof a person who signed the instrument as a party to the instrument,\n\nthe plaintiff has the burden of establishing that the defendant is\n\nliable on the instrument as a represented person under subsection\n\n(a) of Section 65 of this act.\n\n(b) If the validity of signatures is admitted or proved and\n\nthere is compliance with subsection (a) of this section, a plaintiff\n\nproducing the instrument is entitled to payment if the plaintiff\n\nproves entitlement to enforce the instrument under Section 52 of\n\nthis act, unless the defendant proves a defense or claim in\n\nrecoupment.
