Stat. tit. 12A, § 12A-3-309","heading":"Enforcement of Lost, Destroyed, or Stolen Instrument","body":"ENFORCEMENT OF LOST, DESTROYED, OR STOLEN INSTRUMENT\n\n(a) A person not in possession of an instrument is entitled to\n\nenforce the instrument if:\n\n(1) the person seeking to enforce the instrument:\n\n(A) was entitled to enforce the instrument when loss\n\nof possession occurred; or\n\n(B) has directly or indirectly acquired ownership of\n\nthe instrument from a person who was entitled to\n\nenforce the instrument when loss of possession\n\noccurred;\n\n(2) the loss of possession was not the result of a\n\ntransfer by the person or a lawful seizure; and\n\n(3) the person cannot reasonably obtain possession of the\n\ninstrument because the instrument was destroyed, its\n\nwhereabouts cannot be determined, or it is in the\n\nwrongful possession of an unknown person or a person\n\nthat cannot be found or is not amenable to service of\n\nprocess.\n\n(b) A person seeking enforcement of an instrument under\n\nsubsection (a) of this section must prove the terms of the\n\ninstrument and the person's right to enforce the instrument. If\n\nthat proof is made, Section 3-308 of this title applies to the case\n\nas if the person seeking enforcement had produced the instrument.\n\nThe court may not enter judgment in favor of the person seeking\n\nenforcement unless it finds that the person required to pay the\n\ninstrument is adequately protected against loss that might occur by\n\nreason of a claim by another person to enforce the instrument.\n\nAdequate protection may be provided by any reasonable means.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"63943a7f19e29df79fc6f20df4bff081d94039afb17542d6cd00d007640f7818","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-3-308","next":"us-ok/okla.-stat.-tit.-12a-12a-3-310"},"notice":"GroundRules: Original legal text.
