Stat. tit. 12A, § 12A-3-411","heading":"Refusal to Pay Cashier's Checks, Teller's Checks, and","body":"Certified Checks.\n\nREFUSAL TO PAY CASHIER'S CHECKS,\n\nTELLER'S CHECKS, AND CERTIFIED CHECKS\n\n(a) In this section, \"obligated bank\" means the acceptor of a\n\ncertified check or the issuer of a cashier's check or teller's check\n\nbought from the issuer.\n\n(b) If the obligated bank wrongfully (i) refuses to pay a\n\ncashier's check or certified check, (ii) stops payment of a teller's\n\ncheck, or (iii) refuses to pay a dishonored teller's check, the\n\nperson asserting the right to enforce the check is entitled to\n\ncompensation for expenses and loss of interest resulting from the\n\nnonpayment and may recover consequential damages if the obligated\n\nbank refuses to pay after receiving notice of particular\n\ncircumstances giving rise to the damages.\n\n(c) Expenses or consequential damages under subsection (b) of\n\nthis section are not recoverable if the refusal of the obligated\n\nbank to pay occurs because (i) the bank suspends payments, (ii) the\n\nobligated bank asserts a claim or defense of the bank that it has\n\nreasonable grounds to believe is available against the person\n\nentitled to enforce the instrument, (iii) the obligated bank has a\n\nreasonable doubt whether the person demanding payment is the person\n\nentitled to enforce the instrument, or (iv) payment is prohibited by\n\nlaw.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"61435e05b606c9db5abe4a0f66dfcbfdaf57f125d4413c959024dd08d0a47081","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-3-410","next":"us-ok/okla.-stat.-tit.-12a-12a-3-412"},"notice":"GroundRules: Original legal text.
