Stat. tit. 12A, § 12A-3-414","heading":"Obligation of Drawer","body":"OBLIGATION OF DRAWER\n\n(a) This section does not apply to cashier's checks or other\n\ndrafts drawn on the drawer.\n\n(b) If an unaccepted draft is dishonored, the drawer is obliged\n\nto pay the draft (i) according to its terms at the time it was\n\nissued or, if not issued, at the time it first came into possession\n\nof a holder, or (ii) if the drawer signed an incomplete instrument,\n\naccording to its terms when completed, to the extent stated in\n\nSections 3-115 and 3-407 of this title. The obligation is owed to a\n\nperson entitled to enforce the draft or to an indorser who paid the\n\ndraft under Section 3-415 of this title.\n\n(c) If a draft is accepted by a bank, the drawer is discharged,\n\nregardless of when or by whom acceptance was obtained.\n\n(d) If a draft is accepted and the acceptor is not a bank, the\n\nobligation of the drawer to pay the draft if the draft is dishonored\n\nby the acceptor is the same as the obligation of an indorser under\n\nsubsections (a) and (c) of Section 3-415 of this title.\n\n(e) If a draft states that it is drawn \"without recourse\" or\n\notherwise disclaims liability of the drawer to pay the draft, the\n\ndrawer is not liable under subsection (b) of this section to pay the\n\ndraft if the draft is not a check. A disclaimer of the liability\n\nstated in subsection (b) of this section is not effective if the\n\ndraft is a check.\n\n(f) If (i) a check is not presented for payment or given to a\n\ndepositary bank for collection within thirty (30) days after its\n\ndate, (ii) the drawee suspends payments after expiration of the\n\nthirty-day period without paying the check, and (iii) because of the\n\nsuspension of payments, the drawer is deprived of funds maintained\n\nwith the drawee to cover payment of the check, the drawer to the\n\nextent deprived of funds may discharge its obligation to pay the\n\ncheck by assigning to the person entitled to enforce the check the\n\nrights of the drawer against the drawee with respect to the funds.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"71c60457f2508638d600936a29961515c4acef3264b716a8cb0fa056191c6243","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-3-413","next":"us-ok/okla.-stat.-tit.-12a-12a-3-415"},"notice":"GroundRules: Original legal text.
