Stat. tit. 12A, § 12A-3-418","heading":"Payment or Acceptance by Mistake","body":"PAYMENT OR ACCEPTANCE BY MISTAKE\n\n(a) Except as provided in subsection (c) of this section, if\n\nthe drawee of a draft pays or accepts the draft and the drawee acted\n\non the mistaken belief that (i) payment of the draft had not been\n\nstopped pursuant to Section 4-403 of this title or (ii) the\n\nsignature of the drawer of the draft was authorized, the drawee may\n\nrecover the amount of the draft from the person to whom or for whose\n\nbenefit payment was made or, in the case of acceptance, may revoke\n\nthe acceptance. Rights of the drawee under this subsection are not\n\naffected by failure of the drawee to exercise ordinary care in\n\npaying or accepting the draft.\n\n(b) Except as provided in subsection (c) of this section, if an\n\ninstrument has been paid or accepted by mistake and the case is not\n\ncovered by subsection (a) of this section, the person paying or\n\naccepting may, to the extent permitted by the law governing mistake\n\nand restitution, (i) recover the payment from the person to whom or\n\nfor whose benefit payment was made or (ii) in the case of\n\nacceptance, may revoke the acceptance.\n\n(c) The remedies provided by subsection (a) or (b) of this\n\nsection may not be asserted against a person who took the instrument\n\nin good faith and for value or who in good faith changed position in\n\nreliance on the payment or acceptance. This subsection does not\n\nlimit remedies provided by Section 3-417 or 4-407 of this title.\n\n(d) Notwithstanding Section 4-215 of this title, if an\n\ninstrument is paid or accepted by mistake and the payor or acceptor\n\nrecovers payment or revokes acceptance under subsection (a) or (b)\n\nof this section, the instrument is deemed not to have been paid or\n\naccepted and is treated as dishonored, and the person from whom\n\npayment is recovered has rights as a person entitled to enforce the\n\ndishonored instrument.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d02418e1ed70385e05e4dba5d5c6b5c1fad54c34f74ca79d9e95721a760fcd66","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-3-417","next":"us-ok/okla.-stat.-tit.-12a-12a-3-419"},"notice":"GroundRules: Original legal text.
