Stat. tit. 12A, § 12A-3-504","heading":"Excused Presentment and Notice of Dishonor","body":"EXCUSED PRESENTMENT AND NOTICE OF DISHONOR\n\n(a) Presentment for payment or acceptance of an instrument is\n\nexcused if (i) the person entitled to present the instrument cannot\n\nwith reasonable diligence make presentment, (ii) the maker or\n\nacceptor has repudiated an obligation to pay the instrument or is\n\ndead or in insolvency proceedings, (iii) by the terms of the\n\ninstrument presentment is not necessary to enforce the obligation of\n\nindorsers or the drawer, (iv) the drawer or indorser whose\n\nobligation is being enforced has waived presentment or otherwise has\n\nno reason to expect or right to require that the instrument be paid\n\nor accepted, or (v) the drawer instructed the drawee not to pay or\n\naccept the draft or the drawee was not obligated to the drawer to\n\npay the draft.\n\n(b) Notice of dishonor is excused if (i) by the terms of the\n\ninstrument notice of dishonor is not necessary to enforce the\n\nobligation of a party to pay the instrument, or (ii) the party whose\n\nobligation is being enforced waived notice of dishonor.
