Stat. tit. 12A, § 12A-3-602","heading":"Payment","body":"PAYMENT\n\n(a) Subject to subsection (e) of this section, an instrument is\n\npaid to the extent payment is made by or on behalf of a party\n\nobliged to pay the instrument, and to a person entitled to enforce\n\nthe instrument. To the extent of the payment, the obligation of the\n\nparty obliged to pay the instrument is discharged even though\n\npayment is made with knowledge of a claim to the instrument under\n\nSection 3-306 of this title by another person.\n\n(b) Subject to subsection (e) of this section, a note is paid\n\nto the extent payment is made by or on behalf of a party obliged to\n\npay the note to a person that formerly was entitled to enforce the\n\nnote only if at the time of the payment the party obliged to pay has\n\nnot received adequate notification that the note has been\n\ntransferred and that payment is to be made to the transferee. A\n\nnotification is adequate only if it is signed by the transferor or\n\nthe transferee, reasonably identifies the transferred note, and\n\nprovides an address at which payments subsequently are to be made.\n\nUpon request, a transferee shall seasonably furnish reasonable proof\n\nthat the note has been transferred. Unless the transferee complies\n\nwith the request, a payment to the person that formerly was entitled\n\nto enforce the note is effective for purposes of subsection (c) of\n\nthis section even if the party obliged to pay the note has received\n\na notification under this subsection.\n\n(c) Subject to subsection (e) of this section, to the extent of\n\na payment under subsections (a) and (b) of this section, the\n\nobligation of the party obliged to pay the instrument is discharged\n\neven though payment is made with knowledge of a claim to the\n\ninstrument under Section 3-306 of this title by another person.\n\n(d) Subject to subsection (e) of this section, a transferee, or\n\nany party that has acquired rights in the instrument directly or\n\nindirectly from a transferee, including any such party that has\n\nrights as a holder in due course, is deemed to have notice of any\n\npayment that is made under subsection (b) of this section after the\n\ndate that the note is transferred to the transferee but before the\n\nparty obliged to pay the note receives adequate notification of the\n\ntransfer.\n\n(e) The obligation of a party to pay the instrument is not\n\ndischarged under subsections (a) through (d) of this section if:\n\n(1) A claim to the instrument under Section 3-306 of this\n\ntitle is enforceable against the party receiving\n\npayment and (i) payment is made with knowledge by the\n\npayor that payment is prohibited by injunction or\n\nsimilar process of a court of competent jurisdiction,\n\nor (ii) in the case of an instrument other than a\n\ncashier's check, teller's check, or certified check,\n\nthe party making payment accepted, from the person\n\nhaving a claim to the instrument, indemnity against\n\nloss resulting from refusal to pay the person entitled\n\nto enforce the instrument; or\n\n(2) The person making payment knows that the instrument is\n\na stolen instrument and pays a person it knows is in\n\nwrongful possession of the instrument.\n\n(f) As used in this section, “signed”, with respect to a record\n\nthat is not a writing, includes the attachment to or logical\n\nassociation with the record of an electronic symbol, sound, or\n\nprocess with the present intent to adopt or accept the record.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"22efd8dfae387708faac1f3a582657f71884b6184bfd8d45d116032c397ad53f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-3-601","next":"us-ok/okla.-stat.-tit.-12a-12a-3-603"},"notice":"GroundRules: Original legal text.
