Stat. tit. 12A, § 12A-4-104","heading":"Definitions and Index of Definitions","body":"DEFINITIONS AND INDEX OF DEFINITIONS\n\n(a) In this article unless the context otherwise requires:\n\n(1) \"Account\" means any deposit or credit account with a bank,\n\nincluding a demand, time, savings, passbook, share draft, or like\n\naccount, other than an account evidenced by a certificate of\n\ndeposit;\n\n(2) \"Afternoon\" means the period of a day between noon and\n\nmidnight;\n\n(3) \"Banking day\" means the part of a day on which a bank is\n\nopen to the public for carrying on substantially all of its banking\n\nfunctions;\n\n(4) \"Clearing house\" means an association of banks or other\n\npayors regularly clearing items;\n\n(5) \"Customer\" means a person having an account with a bank or\n\nfor whom a bank has agreed to collect items, including a bank that\n\nmaintains an account at another bank;\n\n(6) \"Documentary draft\" means a draft to be presented for\n\nacceptance or payment if specified documents, certified securities\n\n(Section 8-102 of this title) or instructions for uncertificated\n\nsecurities (Section 8-102 of this title) or other certificates,\n\nstatements, or the like are to be received by the drawee or other\n\npayor before acceptance or payment of the draft;\n\n(7) \"Draft\" means a draft as defined in Section 3-104 of this\n\ntitle or an item, other than an instrument, that is an order;\n\n(8) \"Drawee\" means a person ordered in a draft to make payment;\n\n(9) \"Item\" means an instrument or a promise or order to pay\n\nmoney handled by a bank for collection or payment. The term does\n\nnot include a payment order governed by Article 4A of this title or\n\na credit or debit card slip;\n\n(10) \"Midnight deadline\" with respect to a bank is midnight on\n\nits next banking day following the banking day on which it receives\n\nthe relevant item or notice or from which the time for taking action\n\ncommences to run, whichever is later;\n\n(11) \"Settle\" means to pay in cash, by clearing-house\n\nsettlement, in a charge or credit or by remittance, or otherwise as\n\nagreed. A settlement may be either provisional or final; and\n\n(12) \"Suspends payments\" with respect to a bank means that it\n\nhas been closed by order of the supervisory authorities, that a\n\npublic officer has been appointed to take it over or that it ceases\n\nor refuses to make payments in the ordinary course of business.\n\n(b) Other definitions applying to this article and the sections\n\nof this title in which they appear are:\n\n\"Agreement for electronic presentment\" Section 4-110.\n\n\"Collecting bank\" Section 4-105.\n\n\"Depositary bank\" Section 4-105.\n\n\"Intermediary bank\" Section 4-105.\n\n\"Payor bank\" Section 4-105.\n\n\"Presenting bank\" Section 4-105.\n\n\"Presentment Notice\" Section 4-110.\n\n(c) “Control” as provided in Section 7-106 of this title and\n\nthe following definitions in other articles of this title apply to\n\nthis article:\n\n\"Acceptance\" Section 3-409.\n\n\"Alteration\" Section 3-407.\n\n\"Cashier's check\" Section 3-104.\n\n\"Certificate of deposit\" Section 3-104.\n\n\"Certified check\" Section 3-409.\n\n\"Check\" Section 3-104.\n\n\"Draft\" Section 3-104.\n\n\"Good faith\" Section 3-103.\n\n\"Holder in due course\" Section 3-302.\n\n\"Instrument\" Section 3-104.\n\n\"Notice of dishonor\" Section 3-503.\n\n\"Order\" Section 3-103.\n\n\"Ordinary care\" Section 3-103.\n\n\"Person entitled to enforce\" Section 3-301.\n\n\"Presentment\" Section 3-501.\n\n\"Promise\" Section 3-103.\n\n\"Prove\" Section 3-103.\n\n“Record” Section 3-103\n\n\"Teller's check\" Section 3-104.\n\n\"Unauthorized signature\" Section 3-403.\n\n(d) In addition, Article 1 of this title contains general\n\ndefinitions and principles of construction and interpretation\n\napplicable throughout this article.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e0fd8c6a71044b99f70db929a0a1a7653038e60706bd0d248b08b9f6b8b9aa5e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-4-103","next":"us-ok/okla.-stat.-tit.-12a-12a-4-105"},"notice":"GroundRules: Original legal text.
