Stat. tit. 12A, § 12A-4-210","heading":"Security interest of collecting bank in items,","body":"accompanying documents and proceeds.\n\nSECURITY INTEREST OF COLLECTING BANK IN ITEMS,\n\nACCOMPANYING DOCUMENTS AND PROCEEDS\n\n(a) A collecting bank has a security interest in an item and\n\nany accompanying documents or the proceeds of either:\n\n(1) In case of an item deposited in an account, to the extent\n\nto which credit given for the item has been withdrawn or applied;\n\n(2) In case of an item for which it has given credit available\n\nfor withdrawal as of right, to the extent of the credit given,\n\nwhether or not the credit is drawn upon or there is a right of\n\ncharge-back; or\n\n(3) If it makes an advance on or against the item.\n\n(b) If credit given for several items received at one time or\n\npursuant to a single agreement is withdrawn or applied in part, the\n\nsecurity interest remains upon all the items, any accompanying\n\ndocuments or the proceeds of either. For the purpose of this\n\nsection, credits first given are first withdrawn.\n\n(c) Receipt by a collecting bank of a final settlement for an\n\nitem is a realization on its security interest in the item,\n\naccompanying documents, and proceeds. So long as the bank does not\n\nreceive final settlement for the item or give up possession of the\n\nitem or possession or control of the accompanying documents for\n\npurposes other than collection, the security interest continues to\n\nthat extent and is subject to Article 9 of this title, but:\n\n(1) No security agreement is necessary to make the security\n\ninterest enforceable (subparagraph (A) of paragraph (3) of\n\nsubsection (b) of Section 1-9-203 of this title);\n\n(2) No filing is required to perfect the security interest; and\n\n(3) The security interest has priority over conflicting\n\nperfected security interests in the item, accompanying documents, or\n\nproceeds.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"adebddb8c6b004ee5ec69fd6943e9afa695599b7ec6ef185d976a461a4c6c68d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-4-209","next":"us-ok/okla.-stat.-tit.-12a-12a-4-211"},"notice":"GroundRules: Original legal text.
