Stat. tit. 12A, § 12A-4-401","heading":"When Bank May Charge Customer's Account - Statute of","body":"limitations.\n\nWHEN BANK MAY CHARGE CUSTOMER'S ACCOUNT\n\n(a) A bank may charge against the account of a customer an item\n\nthat is properly payable from that account even though the charge\n\ncreates an overdraft. An item is properly payable if it is\n\nauthorized by the customer and is in accordance with any agreement\n\nbetween the customer and bank.\n\n(b) A customer is not liable for the amount of an overdraft if\n\nthe customer neither signed the item nor benefited from the proceeds\n\nof the item.\n\n(c) A bank may charge against the account of a customer a check\n\nthat is otherwise properly payable from the account, even though\n\npayment was made before the date of the check, unless the customer\n\nhas given notice to the bank of the postdating describing the check\n\nwith reasonable certainty. The notice is effective for the period\n\nstated in subsection (b) of Section 4-403 of this title for stop-\n\npayment orders, and must be received at such time and in such manner\n\nas to afford the bank a reasonable opportunity to act on it before\n\nthe bank takes any action with respect to the check described in\n\nSection 4-303 of this title. If a bank charges against the account\n\nof a customer a check before the date stated in the notice of\n\npostdating, the bank is liable for damages for the loss resulting\n\nfrom its act. The loss may include damages for dishonor or\n\nsubsequent items under Section 4-402 of this title.\n\n(d) A bank that in good faith makes payment to a holder may\n\ncharge the indicated account of its customer according to:\n\n(1) The original terms of the altered item; or\n\n(2) The terms of the completed item, even though the bank\n\nknows the item has been completed unless the bank has\n\nnotice that the completion was improper.\n\n(e) The statute of limitations on a customer’s claim that an\n\nitem charged against an account is not properly payable due to a\n\nforged or unauthorized endorsement begins on the date the item is\n\nfinally paid by the bank, without regard to care or lack of care of\n\neither the customer or the bank.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"94ba3fd876be2d93bfec29614e701b2119722d4c70535dfda3d5d88b76526879","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-4-303","next":"us-ok/okla.-stat.-tit.-12a-12a-4-402"},"notice":"GroundRules: Original legal text.
