Stat. tit. 12A, § 12A-7-308","heading":"Enforcement of carrier's lien","body":"Enforcement of Carrier's Lien.\n\n(a) A carrier's lien on goods may be enforced by public or\n\nprivate sale of the goods, in bulk or in packages, at any time or\n\nplace and on any terms that are commercially reasonable, after\n\nnotifying all persons known to claim an interest in the goods. The\n\nnotification must include a statement of the amount due, the nature\n\nof the proposed sale, and the time and place of any public sale.\n\nThe fact that a better price could have been obtained by a sale at a\n\ndifferent time or in a different method from that selected by the\n\ncarrier is not of itself sufficient to establish that the sale was\n\nnot made in a commercially reasonable manner. The carrier sells\n\ngoods in a commercially reasonable manner if the carrier sells the\n\ngoods in the usual manner in any recognized market therefor, sells\n\nat the price current in that market at the time of the sale, or\n\notherwise sells in conformity with commercially reasonable practices\n\namong dealers in the type of goods sold. A sale of more goods than\n\napparently necessary to be offered to ensure satisfaction of the\n\nobligation is not commercially reasonable, except in cases covered\n\nby the preceding sentence.\n\n(b) Before any sale pursuant to this section, any person\n\nclaiming a right in the goods may pay the amount necessary to\n\nsatisfy the lien and the reasonable expenses incurred in complying\n\nwith this section. In that event, the goods may not be sold but\n\nmust be retained by the carrier, subject to the terms of the bill of\n\nlading and this article.\n\n(c) A carrier may buy at any public sale pursuant to this\n\nsection.\n\n(d) A purchaser in good faith of goods sold to enforce a\n\ncarrier's lien takes the goods free of any rights of persons against\n\nwhich the lien was valid, despite the carrier’s noncompliance with\n\nthis section.\n\n(e) A carrier may satisfy its lien from the proceeds of any\n\nsale pursuant to this section but shall hold the balance, if any,\n\nfor delivery on demand to any person to which the carrier would have\n\nbeen bound to deliver the goods.\n\n(f) The rights provided by this section are in addition to all\n\nother rights allowed by law to a creditor against a debtor.\n\n(g) A carrier's lien may be enforced pursuant to either\n\nsubsection (a) of this section or the procedure set forth in\n\nsubsection (b) of Section 7-210 of this title.\n\n(h) A carrier is liable for damages caused by failure to comply\n\nwith the requirements for sale under this section and, in case of\n\nwillful violation, is liable for conversion.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"13dc1cfa9bffd47e7b7ce0a99bb1348ffa9a9b7123ff913a726270f4366eefbd","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-7-307","next":"us-ok/okla.-stat.-tit.-12a-12a-7-309"},"notice":"GroundRules: Original legal text.
