Stat. tit. 12A, § 12A-7-309","heading":"Duty of care - Contractual limitation of carrier's","body":"liability.\n\nDuty of Care; Contractual Limitation of Carrier's Liability.\n\n(a) A carrier that issues a bill of lading, whether negotiable\n\nor nonnegotiable, shall exercise the degree of care in relation to\n\nthe goods which a reasonably careful person would exercise under\n\nsimilar circumstances. This subsection does not affect any statute,\n\nregulation, or rule of law that imposes liability upon a common\n\ncarrier for damages not caused by its negligence.\n\n(b) Damages may be limited by a term in the bill of lading or\n\nin a transportation agreement that the carrier's liability may not\n\nexceed a value stated in the bill or transportation agreement if the\n\ncarrier's rates are dependent upon value and the consignor is\n\nafforded an opportunity to declare a higher value and the consignor\n\nis advised of the opportunity.
