Stat. tit. 12A, § 12A-7-403","heading":"Obligation of bailee to deliver - Excuse","body":"Obligation of Bailee to Deliver; Excuse.\n\n(a) A bailee shall deliver the goods to a person entitled under\n\na document of title if the person complies with subsections (b) and\n\n(c) of this section, unless and to the extent that the bailee\n\nestablishes any of the following:\n\n(1) delivery of the goods to a person whose receipt was\n\nrightful as against the claimant;\n\n(2) damage to or delay, loss, or destruction of the goods for\n\nwhich the bailee is not liable;\n\n(3) previous sale or other disposition of the goods in lawful\n\nenforcement of a lien or on warehouse’s lawful termination of\n\nstorage;\n\n(4) the exercise by a seller of its right to stop delivery\n\npursuant to Section 2-705 of this title or by a lessor of its right\n\nto stop delivery pursuant to Section 2A-526 of this title;\n\n(5) a diversion, reconsignment or other disposition pursuant to\n\nSection 7-303 of this title;\n\n(6) release, satisfaction or any other personal defense against\n\nthe claimant; or\n\n(7) any other lawful excuse.\n\n(b) A person claiming goods covered by a document of title\n\nshall satisfy the bailee's lien if the bailee so requests or if the\n\nbailee is prohibited by law from delivering the goods until the\n\ncharges are paid.\n\n(c) Unless the person claiming the goods is a person against\n\nwhich the document of title does not confer a right under subsection\n\n(a) of Section 7-503 of this title:\n\n(1) the person claiming under a document shall surrender\n\npossession or control of any outstanding negotiable document\n\ncovering the goods for cancellation or indication of partial\n\ndeliveries; and\n\n(2) the bailee shall cancel the document or conspicuously\n\nindicate in the document the partial delivery or the bailee is\n\nliable to any person to which the document is duly negotiated.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e4748989ed808bc0221a4f3e7be16639ce37d34806c0d6fffa554e0f791c70b1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-7-402","next":"us-ok/okla.-stat.-tit.-12a-12a-7-404"},"notice":"GroundRules: Original legal text.
