Stat. tit. 12A, § 12A-7-601","heading":"Lost, stolen, or destroyed documents of title","body":"Lost, Stolen, or Destroyed Documents of Title.\n\n(a) If a document has been lost, stolen, or destroyed, a court\n\nmay order delivery of the goods or issuance of a substitute document\n\nand the bailee may without liability to any person comply with the\n\norder. If the document was negotiable, a court may not order\n\ndelivery of the goods or issuance of a substitute document without\n\nthe claimant’s posting security unless it finds that any person that\n\nmay suffer loss as a result of nonsurrender of possession or control\n\nof the document is adequately protected against the loss. If the\n\ndocument was not negotiable, the court may require security. The\n\ncourt may also order payment of the bailee's reasonable costs and\n\nattorney fees in any action under this section.\n\n(b) A bailee that, without court order, delivers goods to a\n\nperson claiming under a missing negotiable document of title is\n\nliable to any person injured thereby. If the delivery is not in\n\ngood faith, the bailee is liable for conversion. Delivery in good\n\nfaith is not conversion if the claimant posts security with the\n\nbailee in an amount at least double the value of the goods at the\n\ntime of posting to indemnify any person injured by the delivery\n\nwhich files a notice of claim within one (1) year after the\n\ndelivery.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a7d1b48cade8f364ee3d387d369b4cb24f49b0d836c0299322be8c5b8e9965fc","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-7-509","next":"us-ok/okla.-stat.-tit.-12a-12a-7-602"},"notice":"GroundRules: Original legal text.
