Stat. tit. 12A, § 12A-8-114","heading":"Evidentiary Rules Concerning Certificated Securities","body":"\n\nEvidentiary Rules Concerning Certificated Securities.\n\nThe following rules apply in an action on a certificated\n\nsecurity against the issuer:\n\n(1) Unless specifically denied in the pleadings, each\n\nsignature on a security certificate or in a necessary\n\nindorsement is admitted;\n\n(2) If the effectiveness of a signature is put in issue,\n\nthe burden of establishing effectiveness is on the\n\nparty claiming under the signature, but the signature\n\nis presumed to be genuine or authorized;\n\n(3) If signatures on a security certificate are admitted\n\nor established, production of the certificate entitles\n\na holder to recover on it unless the defendant\n\nestablishes a defense or a defect going to the\n\nvalidity of the security; and\n\n(4) If it is shown that a defense or defect exists, the\n\nplaintiff has the burden of establishing that the\n\nplaintiff or some person under whom the plaintiff\n\nclaims is a person against whom the defense or defect\n\ncannot be asserted.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"498b7ab0e8091c794406b0a16e671fc1156dd1f82ea605b843fe373f794662f8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-8-113","next":"us-ok/okla.-stat.-tit.-12a-12a-8-115"},"notice":"GroundRules: Original legal text.
