Stat. tit. 13, § 13-176.2","heading":"Definitions","body":"As used in the Security of Communications Act:\n\n1. \"Aggrieved person\" means a person who was a party to any\n\nintercepted wire, oral or electronic communication or a person\n\nagainst whom the interception was directed;\n\n2. \"Aural acquisition\" means obtaining knowledge of a\n\ncommunication through the sense of hearing which is contemporaneous\n\nwith the communication;\n\n3. \"Aural transfer\" means a transfer containing the human voice\n\nat any point between and including the point of origin and the point\n\nof reception;\n\n4. \"Communication common carrier\" means, for the purposes of\n\nthe Security of Communications Act only, any telephone or telegraph\n\ncompany, rural telephone cooperative, communications transmission\n\ncompany or other public communications company under the laws of\n\nthis state;\n\n5. \"Communication facility\" means any and all public and\n\nprivate instrumentalities used or useful in the transmission of\n\nwriting, signs, signals, pictures, or sounds of all kinds and\n\nincludes mail, telephone, wire, radio, and all other means of\n\ncommunication;\n\n6. \"Contents\", when used with respect to any wire, oral or\n\nelectronic communication, includes any information concerning the\n\nsubstance, purport or meaning of that communication;\n\n7. \"Electronic communication\" means any transfer of signs,\n\nsignals, writing, images, sounds, data, or intelligence of any\n\nnature transmitted in whole or in part by a wire, radio,\n\nelectromagnetic, photoelectronic or photo-optical system, but does\n\nnot include:\n\na. any wire or oral communication,\n\nb. any communication made through a tone-only paging\n\ndevice, or\n\nc. any communication from a tracking device;\n\n8. \"Electronic, mechanical or other device\" means any device or\n\napparatus which can be used to intercept a wire, oral or electronic\n\ncommunication other than:\n\na. any telephone or telegraph instrument, equipment or\n\nfacility or any component thereof furnished to the\n\nsubscriber or user by a communication common carrier\n\nor other lawful supplier in the ordinary course of its\n\nbusiness which is being used by the subscriber or user\n\nin the ordinary course of its business, or being used\n\nby a communication common carrier in the ordinary\n\ncourse of business or being used by a law enforcement\n\nofficer in the ordinary course of duties, or\n\nb. a hearing aid or similar device being used to correct\n\nsubnormal hearing to not better than normal;\n\n9. \"Intercept\" means the aural acquisition of the contents of\n\nany wire, oral or electronic communication through the use of any\n\nelectronic, mechanical or other device;\n\n10. \"Judge of competent jurisdiction\" means the Presiding Judge\n\nof the Court of Criminal Appeals or any other Judge of the Court of\n\nCriminal Appeals designated by the Presiding Judge;\n\n11. \"Law enforcement officer\" means any person who is employed\n\nby the United States, this state or political subdivision thereof\n\nand is empowered by law to conduct investigations of, or to make\n\narrests for, offenses enumerated in the Security of Communications\n\nAct or similar federal offenses and any attorney authorized by law\n\nto prosecute or participate in the prosecution of such offenses;\n\n12. \"Oral communication\" means any communication uttered by a\n\nperson exhibiting an expectation that such communication is not\n\nsubject to interception under circumstance justifying such\n\nexpectation;\n\n13. \"Person\" means any individual, partnership, association,\n\njoint-stock company, trust, corporation or political subdivision\n\nincluding an employee or agent thereof; and\n\n14. \"Wire communication\" means any aural transfer made in whole\n\nor in part through the use of facilities for the transmission of\n\ncommunications by the aid of wire, cable or other like connection\n\nbetween the point of origin and the point of reception, including\n\nthe use of such connection in a switching station, furnished or\n\noperated by any person engaged in providing or operating such\nof;
