Stat. tit. 13, § 13-177.6","heading":"Search warrant for installation or use of tracking","body":"device - Period of monitoring - Service of warrant upon affected\n\npersons.\n\nA. Any magistrate may issue a search warrant authorizing the\n\ninstallation or use of a tracking device in any moveable item,\n\ncontainer, vehicle or other vessel. Such warrant may authorize the\n\nuse of that tracking device within the jurisdiction of the\n\nmagistrate, and outside that jurisdiction if the tracking device is\n\ninstalled within the magistrate’s jurisdiction. No such warrant\n\nshall issue unless probable cause is shown for believing that such\n\ninstallation or use will lead to the discovery of evidence, fruits,\n\nor instrumentalities of the commission or attempted commission of an\n\noffense. Any application or affidavit seeking such a search warrant\n\nshall inform the magistrate of the name or names of the persons, if\n\nknown, likely to have a reasonable expectation of privacy in the\n\narea where the tracking device is to be installed. Nothing here\n\nshall be construed as requiring a warrant for such installation or\n\nuse if a warrant is not required under the Constitution of the\n\nUnited States of America.\n\nB. Search warrants issued under this section may authorize\n\nintrusions into the item, container, vehicle or vessel for the\n\npurpose of installing the tracking device or for maintenance or\n\nretrieval of the tracking device. No search warrant issued under\n\nthis section shall permit the monitoring of a tracking device for\n\nlonger than sixty (60) days unless an extension warrant is issued by\n\nthe magistrate upon a renewed showing of probable cause as required\n\nin subsection A of this section.\n\nC. Within ninety (90) days after the expiration of any period\n\nof authorized monitoring of a tracking device, including any\n\nextensions thereof, the law enforcement officer who obtained the\n\nsearch warrant shall serve a copy of the search warrant which was\n\nobtained pursuant to this section upon the person or persons likely\n\nto have a reasonable expectation of privacy in the area where the\n\ntracking device was installed. This ninety-day period may be\n\nextended by the court for good cause shown.
