Stat. tit. 13, § 13-178","heading":"Short title - Kelsey Smith Act – Wireless","body":"telecommunications carriers to provide call location information to\n\nlaw enforcement.\n\nA. This act shall be known and may be cited as the \"Kelsey\n\nSmith Act\".\n\nB. As used in this act, \"law enforcement agency\" means any\n\ndepartment or agency of this state or a political subdivision of\n\nthis state that employs personnel certified by the Council on Law\n\nEnforcement Education and Training and is empowered by law to\n\nmaintain public order, make arrests and enforce the criminal laws of\n\nthis state or municipal ordinances.\n\nC. Upon request of a law enforcement agency, a wireless\n\ntelecommunications carrier shall provide call location information\n\nof the telecommunications device of a user to the requesting agency\n\nin order to respond to a call for emergency services or in an\n\nemergency situation that involves risk of death or serious physical\n\nharm. If call location information is provided to a law enforcement\n\nagency for the purposes set forth in this section, notice shall be\n\ngiven to the user within thirty (30) days after the call for\n\nemergency services or the emergency situation.\n\nD. A wireless telecommunications carrier registered to do\n\nbusiness in this state or otherwise submitting to the jurisdiction\n\nof this state and a reseller of wireless telecommunications services\n\nshall submit emergency contact information for the carrier to the\n\nOklahoma State Bureau of Investigation (OSBI) to facilitate requests\n\nfrom a law enforcement agency for call location information in\n\naccordance with this section. Such contact information shall be\n\nsubmitted annually by July 1 or immediately upon any change in\n\ncontact information. The OSBI shall maintain a database containing\n\nemergency contact information for carriers required pursuant to this\n\nsubsection and shall make the information immediately available upon\n\nrequest to any law enforcement agency in this state. The OSBI shall\n\npromulgate rules to implement the requirements of this subsection.\n\nNothing in this subsection shall be construed to require carriers to\n\nsubmit emergency contact information for individual customers to the\n\nOSBI.\n\nE.
