Stat. tit. 14A, § 14A-2-301","heading":"Applicability - Information required","body":"(1) For purposes of this part, this part covers and consumer\n\ncredit sale includes the sale of an interest in land without regard\n\nto the rate of the credit service charge if the sale is otherwise a\n\nconsumer credit sale as defined by Section 2-104 of this title; a\n\nsale of personal property in which a security interest is or will be\n\nacquired which is used or expected to be used as the principal\n\ndwelling of the consumer without regard to the amount of the amount\n\nfinanced if the sale is otherwise a consumer credit sale; and credit\n\ntransactions in which any card issuer extends credit that is not\n\nsubject to a finance charge and that is not payable by written\n\nagreement in four or more installments.\n\n(2) The seller or lessor shall disclose to the buyer to whom\n\ncredit is extended or lessee with respect to a consumer credit sale\n\nor consumer lease the information required by either this part or\n\nthe Federal Consumer Credit Protection Act, and compliance with\n\neither is sufficient.\n\n(3) For the purposes of subsection (2), information which would\n\notherwise be required pursuant to the Federal Consumer Credit\n\nProtection Act is sufficient even though the transaction is one of a\n\nclass of credit transactions exempted from that act pursuant to\n\nregulation of the Board of Governors of the Federal Reserve System.\n\n(4) A person who regularly arranges for the extension of\n\nconsumer sales credit which is payable in four or more installments\n\nor for which the payment of a finance charge is or may be required\n\nfrom persons who are not subject to disclosure duties shall make the\n\ndisclosures required of a seller under this part.\n\n(5) In the case of an application to open an account under any\n\nrevolving charge account plan described in Section 2-310.2 of this\n\ntitle which is provided to a consumer by any person other than the\n\ncreditor:\n\n(a) such person shall provide such consumer with:\n\n(i) the disclosures required under subsection (1) of\n\nSection 2-310.2 of this title with respect to\n\nsuch plan, in accordance with subsection (9) of\n\nSection 2-302 of this title; and\n\n(ii) the pamphlet required under subsection (3) of\n\nSection 2-310.2 of this title; or\n\n(b) if such person cannot provide specific terms about the\n\nplan because specific information about the plan terms\n\nis not available, no nonrefundable fee may be imposed\n\nin connection with such application before the end of\n\nthe three-day period beginning on the date the\n\nconsumer receives the disclosures required under\n\nsubsection (1) of Section 2-310.2 with respect to the\n\napplication.\n\n(6) For purposes of this part, the terms \"creditor\", \"card\n\nissuer\", \"applicant\", \"cardholder\", \"dwelling\" and \"consumer\" have\n\nthe same meanings those terms have in the Federal Consumer Credit\n\nProtection Act, as limited by the subject matter of this article.\n\nReferences in this part to \"interest\" are not limited to the\n\ndefinition of that term in Section 264A of Title 15 of the Oklahoma\n\nStatutes but are to be construed in context consistently with the\n\nmeaning of that term in regulations under the Federal Consumer\n\nCredit Protection Act.\n\n(7) The fact a charge or fee or a credit plan or a practice is\n\nmentioned in this part does not itself serve to authorize it, to\n\nremove any limitation in this title applicable to it, or to extend\n\nthe applicability of this article to it if this article would not\n\notherwise apply.","path":["OK Code","Title 14A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os14A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5a4840d2104c7be584b80ac68d1d1625d9cf8aae2752caca46a0d30ea5505520","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-14a-14a-2-211","next":"us-ok/okla.-stat.-tit.-14a-14a-2-301.1"},"notice":"GroundRules: Original legal text.
