Stat. tit. 14A, § 14A-2-504","heading":"Restoration of down payment - Retention of cancellation","body":"fee.\n\n(1) Except as provided in this section, within ten (10) days\n\nafter a home solicitation sale has been cancelled or an offer to\n\npurchase revoked the seller must tender to the buyer any payments\n\nmade by the buyer and any note or other evidence of indebtedness.\n\n(2) If the down payment includes goods traded in, the goods\n\nmust be tendered in substantially as good condition as when received\n\nby the seller. If the seller fails to tender the goods as provided\n\nby this section, the buyer may elect to recover an amount equal to\n\nthe trade-in allowance stated in the agreement.\n\n(3) The seller may retain as a cancellation fee five percent\n\n(5%) of the cash price but not exceeding the amount of the cash down\n\npayment. If the seller fails to comply with an obligation imposed\n\nby this section, or if the buyer avoids the sale on any ground\n\nindependent of his right to cancel provided by the provisions on the\n\nbuyer's right to cancel (subsection (1) of Section 2-502) or revokes\n\nhis offer to purchase, the seller is not entitled to retain a\n\ncancellation fee.\n\n(4) Until the seller has complied with the obligations imposed\n\nby this section the buyer may retain possession of goods delivered\n\nto him by the seller and has a lien on the goods in his possession\n\nor control for any recovery to which he is entitled.","path":["OK Code","Title 14A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os14A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3c8e3b0dc7f4cdce7d5613c395bcfb8232df20e8c2e9770f9a5a597c9fee7c7e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-14a-14a-2-503","next":"us-ok/okla.-stat.-tit.-14a-14a-2-505"},"notice":"GroundRules: Original legal text.
