Stat. tit. 14A, § 14A-3-505","heading":"Hearing examiner - Powers - Reinstatement - Certain","body":"disclosures required of licensee.\n\n(1) The Administrator of Consumer Credit shall appoint an\n\nindependent hearing examiner to conduct all administrative hearings\n\ninvolving alleged violations of this title. The independent hearing\n\nexaminer shall have authority to exercise all powers granted by\n\nArticle II of the Administrative Procedures Act in conducting\n\nhearings. The independent hearing examiner shall recommend\n\npenalties authorized by this title and issue proposed orders, with\n\nproposed findings of fact and proposed conclusions of law, to the\n\nAdministrator pursuant to Article II of the Administrative\n\nProcedures Act. The Administrator shall review the proposed order\n\nand issue a final agency order in accordance with Article II of the\n\nAdministrative Procedures Act. The costs of the hearing examiner\n\nmay be assessed by the hearing examiner against the respondent,\n\nunless the respondent is the prevailing party. Any person aggrieved\n\nby a final agency order of the Administrator may obtain judicial\n\nreview in accordance with the Administrative Procedures Act. The\n\njurisdiction and venue of any such action shall be in the district\n\ncourt of Oklahoma County.\n\n(2) The Administrator may, after notice and hearing, censure,\n\nprobate, suspend, revoke or refuse to renew any license, or in\n\naddition to or in lieu of censure, probation, suspension or\n\nrevocation, order refunds for unlawful charges if the Administrator\n\nfinds that:\n\n(a) The licensee has failed to pay the annual license fee\n\nimposed by this title, or an examination fee,\n\ninvestigation fee or other fee or charge imposed by\n\nthe Administrator under the authority of this title,\n\n(b) The licensee, either knowingly or without the exercise\n\nof due care to prevent the same, has violated any\n\nprovision of this title or any regulation or order\n\nlawfully made pursuant to and within the authority of\n\nthis title, or\n\n(c) Any fact or condition exists which, if it had existed\n\nor had been known to exist at the time of the original\n\napplication for such license, clearly would have\n\njustified the Administrator in refusing to issue such\n\nlicense.\n\n(3) Any licensee may surrender any license by delivering it to\n\nthe Administrator with written notice of its surrender, but such\n\nsurrender shall not affect the administrative, civil or criminal\n\nliability for acts committed prior thereto.\n\n(4) No revocation, suspension, or surrender of any license\n\nshall impair or affect the obligation of any preexisting lawful\n\ncontract between the licensee and any borrower.\n\n(5) The Administrator may reinstate suspended licenses or issue\n\nnew licenses to a person whose license or licenses have been revoked\n\nif no fact or condition then exists which clearly would have\n\njustified the Administrator or the independent hearing examiner in\n\nrefusing originally to issue such license under this part.\n\n(6) Every licensee shall notify the Administrator of the\n\nconviction of or plea of guilty or nolo contendere to any felony\n\nwithin thirty (30) days after the plea is taken and also within\n\nthirty (30) days of the entering of an order of judgment and\n\nsentencing and shall notify the Administrator of any administrative\n\naction resulting in revocation, suspension, or amendment of a\n\nlicense taken against the licensee in another state within thirty\n\n(30) days of the entering of the administrative order in that state.","path":["OK Code","Title 14A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os14A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"21408e778cdfbc7eaa7d07073ae8c7c281c6b7d6656012a336b73c6f9072dd66","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-14a-14a-3-504","next":"us-ok/okla.-stat.-tit.-14a-14a-3-506"},"notice":"GroundRules: Original legal text.
