A consumer litigation funding agreement shall contain the\n\ndisclosures required by this section. The disclosures shall be\n\nclear and conspicuous and in at least twelve-point bold type, except\n\nas provided by subsection F of this section.\n\nB. On the front page of the agreement under appropriate\n\nheadings, the agreement shall disclose:\n\n1. The funded amount to be paid to the consumer by the consumer\n\nlitigation funder;\n\n2. An itemization of one-time charges;\n\n3. The total amount to be assigned by the consumer to the\n\nfunder, including the funded amount and all charges; and\n\n4. A payment schedule that:\n\na. includes the funded amount and charges, and\n\nb. lists all dates and the amount due at the end of each\n\none-hundred-eighty-day period from the funding date\n\nuntil the due date of the maximum amount due to the\n\nfunder by the consumer to satisfy the amount owed\n\nunder the agreement.\n\nC. Pursuant to the requirements set forth in this act, the\n\nagreement shall contain the following statement: \"CONSUMER'S RIGHT\n\nTO CANCELLATION: You may cancel this agreement without penalty or\n\nfurther obligation within five business days after the funding date\n\nif you either:\n\n1. Return to the consumer litigation funder the full amount of\n\nthe disbursed funds by delivering the funder's uncashed check to the\n\nfunder's office in person; or\n\n2. Send, by insured, certified, or registered United States\n\nmail, to the funder at the address specified in the agreement, a\n\nnotice of cancellation and include in the mailing a return of the\n\nfull amount of disbursed funds in the form of the funder's uncashed\n\ncheck or a registered or certified check or money order.\"\n\nD. The agreement shall disclose that:\n\n1. The consumer litigation funder may not participate in\n\ndeciding whether, when, or the amount for which a legal claim is\n\nsettled;\n\n2. The funder may not interfere with the independent\n\nprofessional judgment of the attorney handling the legal claim or\n\nany settlement of the legal claim; and\n\n3. The consumer shall notify the funder of the settlement or\n\nadjudication of the legal claim before the resolution date.\n\nE. The agreement shall contain in all capital letters the\n\nfollowing text within a box: \"THE FUNDED AMOUNT AND AGREED TO\n\nCHARGES SHALL BE PAID ONLY FROM THE PROCEEDS OF YOUR LEGAL CLAIM,\n\nAND SHALL BE PAID ONLY TO THE EXTENT THAT THERE ARE AVAILABLE\n\nPROCEEDS FROM YOUR LEGAL CLAIM. YOU WILL NOT OWE (INSERT NAME OF\n\nTHE CONSUMER LITIGATION FUNDER) ANYTHING IF THERE ARE NO PROCEEDS\n\nFROM YOUR LEGAL CLAIM, UNLESS YOU HAVE VIOLATED ANY MATERIAL TERM OF\n\nTHIS AGREEMENT OR YOU HAVE COMMITTED FRAUD AGAINST THE CONSUMER\n\nLITIGATION FUNDER.\"\n\nF. Immediately above the line for the consumer's signature, the\n\nagreement shall contain the following disclosure in twelve-point\n\ntype: \"Do not sign this agreement before you read it completely or\n\nif it contains any blank spaces. You are entitled to a completed\n\ncopy of the agreement. Before you sign this agreement, you should\n\nobtain the advice of an attorney.
