Stat. tit. 14A, § 14A-3-814","heading":"Prohibited activities or conduct","body":"PROHIBITED ACTIVITIES OR CONDUCT.\n\nA consumer litigation funder may not:\n\n1. Pay or offer to pay a commission, referral fee, or other\n\nform of consideration to an attorney, law firm, medical provider,\n\nchiropractor, or physical therapist or an employee of such a person\n\nfor referring a consumer to the funder;\n\n2. Accept any commission, referral fee, rebate, or other form\n\nof consideration from an attorney, law firm, medical provider,\n\nchiropractor, or physical therapist or an employee of such a person;\n\n3. Intentionally advertise materially false or misleading\n\ninformation about the funder's products or services;\n\n4. Refer, to further an initial legal funding, a customer or\n\npotential customer to a specific attorney, law firm, medical\n\nprovider, chiropractor, or physical therapist or an employee of such\n\na person, except that the funder may refer a customer or potential\n\ncustomer who needs legal representation to a local or state bar\n\nassociation referral service;\n\n5. Fail to promptly supply a copy of the executed agreement to\n\nthe consumer's attorney;\n\n6. Knowingly provide funding to a consumer who has previously\n\nassigned or sold a portion of the consumer's right to proceeds from\n\nthe consumer's legal claim without first paying to or purchasing\n\nfrom a previously unsatisfied consumer litigation funder that\n\nfunder's entire funded amount and charges due under that funder's\n\napplicable agreement, unless:\n\na. a lesser amount is otherwise agreed to in writing by\n\nthe consumer litigation funders, or\n\nb. multiple funders have agreed to concurrently provide\n\nfunding to a consumer, if the consumer consents to the\n\narrangement in writing;\n\n7. Make a decision relating to the conduct, settlement, or\n\nresolution of the underlying legal claim, the power of which shall\n\nremain solely with the consumer and the attorney handling the legal\n\nclaim; or\n\n8.
