The following records in the Oklahoma Department of Consumer\n\nCredit are designated as public records:\n\n1. All applications for licensure and supporting information\n\nwith the exception of personal financial records of individual\n\napplicants, dates of birth, Social Security numbers, signatures and\n\nfingerprints;\n\n2. All records introduced at administrative hearings; and\n\n3. All records related to licensed entities filed in the Office\n\nof the Secretary of State.\n\nB. All other records in the Department shall be confidential\n\nand not subject to public inspection. However, the Commission on\n\nConsumer Credit, Administrator of Consumer Credit or Deputy\n\nAdministrator may divulge such confidential information with the\n\nwritten approval of the Administrator after receipt of a written\n\nrequest which shall:\n\n1. Specify the record or records to which access is requested;\n\nand\n\n2. Give the reasons for the request.\n\nSuch records may also be produced pursuant to a valid judicial\n\nsubpoena or other legal process requiring production, if the\n\nAdministrator determines that the records are relevant to the\n\nhearing or proceeding and that production is in the best interests\n\nof justice. The records may be disclosed only after a determination\n\nby the Administrator that good cause exists for the disclosure.\n\nEither prior to or at the time of any disclosure, the Administrator\n\nshall impose such terms and conditions as the Administrator deems\n\nnecessary to protect the confidential nature of the record, the\n\nfinancial integrity of any institution to which the record relates\n\nand the legitimate privacy interests of any individual named in such\n\nrecords.\n\nC. All documents which the Department is required, by any\n\nprovision of any act administered by the Administrator or by any\n\nother statute or regulation of this state, to retain or preserve in\n\nits possession may be retained and preserved, in lieu of retention\n\nof the original records or copies, in an electronic format and\n\nstored by electronic imaging or otherwise so that the documents may\n\nbe later reproduced as necessary. Any such electronically stored or\n\nimaged document or reproduction shall have the same force and effect\n\nas the original thereof and shall be admitted in evidence equally\n\nwith the original.\n\nD. With respect to records of the Department which are\n\nconsidered public records, and which are subject to the Oklahoma\n\nOpen Records Act, the Department may charge a document copying fee\n\nof twenty-five cents ($0.25) per page. With respect to records of\n\nthe Department which are not considered public records, the\n\nDepartment may charge a document copying fee of One Dollar ($1.00)\n\nper page, and if the Administrator, pursuant to the provisions of\n\nsubsection B of this section, permits the inspection or copying of\n\nan examination report prepared by the Department, a minimum fee of\n\nOne Hundred Dollars ($100.00) shall be charged.","path":["OK Code","Title 14A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os14A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"467ff1044c388d274fc62433fb08e52a9c7d7c964ef6d79c0e88725f7aa6632f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-14a-14a-6-116","next":"us-ok/okla.-stat.-tit.-14a-14a-6-117.1"},"notice":"GroundRules: Original legal text.
