Stat. tit. 14A, § 14A-6-117.1","heading":"Availability of data to agencies with direct","body":"supervisory authority.\n\nA. A supervisory agency shall make available to a requesting\n\nagency any data obtained or generated by, and in the possession of,\n\nthe supervisory agency and that the requesting agency deems\n\nnecessary for review in connection with the supervision of any\n\nperson over which the requesting agency has direct supervisory\n\nauthority. However, the requested data must relate to the person,\n\nor an affiliate of the person, over which the requesting agency has\n\ndirect supervisory authority. An agency has direct supervisory\n\nauthority over a person if such authority is specifically provided\n\nby statute, or the agency granted the charter, license or\n\nregistration of the person, or otherwise granted permission for the\n\nperson to conduct its business in this state.\n\nB. When a requesting agency and a federal regulatory agency or\n\nself-regulatory association have concurrent jurisdiction over a\n\nperson, a requesting agency may share with such agency or\n\nassociation data received from a supervisory agency. However, the\n\nfederal regulatory agency or self-regulatory association shall\n\nreturn such shared data to the requesting agency unless the federal\n\nregulatory agency or self-regulatory association has obtained\n\napproval from the supervisory agency to retain the data. The term\n\n\"federal regulatory agency\" shall not include law enforcement\n\nagencies.\n\nC. 1. All data received by a requesting agency from a\n\nsupervisory agency shall be and shall remain confidential and not\n\nopen to public inspection, subpoena or any other form of disclosure\n\nwhile in the possession of the requesting agency. Any request for\n\ninspection, subpoena or other form of disclosure shall be directed\n\nto the supervisory agency from which the data originated and\n\ndisclosure thereof shall be subject to the laws, rules and policies\n\ngoverning or relating to records of the supervisory agency.\n\n2. The providing of data by a supervisory agency to a\n\nrequesting agency under this section shall not constitute a waiver\n\nof or otherwise affect any privilege or claim of confidentiality\n\nthat a supervisory agency may claim with respect to such data under\n\nany federal laws or laws of this state.\n\nD. A supervisory agency shall not be required to share original\n\ndocuments with a requesting agency. A requesting agency shall\n\nreimburse the supervisory agency for costs associated with providing\n\ncopies of data to the requesting agency.\n\nE. As used in this section:\n\n1. \"Affiliate\" means any person that controls, is controlled by\n\nor is under common control with another person. A person shall be\n\ndeemed to have \"control\" over any person if the person:\n\na. directly or indirectly or acting through one or more\n\nother persons owns, controls or has power to vote ten\n\npercent (10%) or more of any class of voting\n\nsecurities of the other person, or\n\nb. controls in any manner the election, appointment or\n\ndesignation of a majority of the directors, trustees\n\nor other managing officers of the person;\n\n2. \"Data\" means copies of any documents, reports, examination\n\nreports, letters, correspondence, orders, stipulations, memorandums\n\nof understanding, agreements or any other records not open for\n\npublic inspection generated by a supervisory agency or obtained by a\n\nsupervisory agency from the person it supervises, whether in paper\n\nor electronic format. However, data shall not include records that\n\na requesting agency receives from a supervisory agency pursuant to\n\nthis section;\n\n3. \"Requesting agency\" means, as applicable, the Oklahoma\n\nDepartment of Consumer Credit, the Oklahoma State Banking\n\nDepartment, the Oklahoma Insurance Department or the Oklahoma\n\nDepartment of Securities that requests from a supervisory agency\n\ndata relating to a person over which the requesting agency does not\n\nhave direct supervisory authority;\n\n4. \"Supervision\" means any examination, assessment, order,\nting agency\" means, as applicable, the Oklahoma\n\nDepartment of Consumer Credit, the Oklahoma State Banking\n\nDepartment, the Oklahoma Insurance Department or the Oklahoma\n\nDepartment of Securities that requests from a supervisory agency\n\ndata relating to a person over which the requesting agency does not\n\nhave direct supervisory authority;\n\n4. \"Supervision\" means any examination, assessment, order,\n\nstipulation, agreement, report, memorandum of understanding or other\n\nregulatory matter or process that a requesting agency is authorized\n\nto perform in relation to a person; and\n\n5. \"Supervisory agency\" means, as applicable, the Oklahoma\n\nDepartment of Consumer Credit, the Oklahoma State Banking\n\nDepartment, the Oklahoma Insurance Department or the Oklahoma\n\nDepartment of Securities that maintains data relating to a person\n\nover which the agency has direct supervisory authority.","path":["OK Code","Title 14A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os14A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"04d0f83fe42d7b683661cfc54f437f48f63f80ecbb672a5d21bf608668065a96","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-14a-14a-6-117","next":"us-ok/okla.-stat.-tit.-14a-14a-6-201"},"notice":"GroundRules: Original legal text.
