Stat. tit. 15, § 15-1006","heading":"Construction of power relating to real property","body":"transactions.\n\nCONSTRUCTION OF POWER RELATING TO REAL PROPERTY TRANSACTIONS\n\nIn a statutory power of attorney, the language granting power\n\nwith respect to real property transactions empowers the agent to:\n\n1. Accept as a gift or as security for a loan, reject, demand,\n\nbuy, lease, receive, or otherwise acquire, an interest in real\n\nproperty or a right incident to real property;\n\n2. Sell, exchange, convey with or without covenants, quitclaim,\n\nrelease, surrender, mortgage, encumber, partition, consent to\n\npartitioning, subdivide, apply for zoning, rezoning, or other\n\ngovernmental permits, plat or consent to platting, develop, grant\n\noptions concerning, lease, sublease, or otherwise dispose of, an\n\ninterest in real property or a right incident to real property;\n\n3. Release, assign, satisfy, and enforce by litigation or\n\notherwise, a mortgage, deed of trust, encumbrance, lien, or other\n\nclaim to real property which exists or is asserted;\n\n4. Do any act of management or of conservation with respect to\n\nan interest in real property, or a right incident to real property,\n\nowned, or claimed to be owned, by the principal, including:\n\na. insuring against a casualty, liability, or loss,\n\nb. obtaining or regaining possession, or protecting the\n\ninterest or right, by litigation or otherwise,\n\nc. paying, compromising, or contesting taxes or\n\nassessments, or applying for and receiving refunds in\n\nconnection with them, and\n\nd. purchasing supplies, hiring assistance or labor, and\n\nmaking repairs or alterations in the real property;\n\n5. Use, develop, alter, replace, remove, erect, or install\n\nstructures or other improvements upon real property in or incident\n\nto which the principal has, or claims to have, an interest or right;\n\n6. Participate in a reorganization with respect to real\n\nproperty or a legal entity that owns an interest in or right\n\nincident to real property and receive and hold shares of stock or\n\nobligations received in a plan of reorganization, and act with\n\nrespect to them, including:\n\na. selling or otherwise disposing of them,\n\nb. exercising or selling an option, conversion, or\n\nsimilar right with respect to them, and\n\nc. voting them in person or by proxy;\n\n7. Change the form of title of an interest in or right incident\n\nto real property; and\n\n8.
