No service warranty form or related form shall be issued or\n\nused in this state unless the form has been filed with the Insurance\n\nCommissioner. Service warranty forms shall not be subject to prior\n\napproval and shall be filed with the Insurance Commissioner for\n\ninformational purposes only.\n\nB. Each service warranty contract shall contain a cancelation\n\nprovision. In the event the contract is canceled by the warranty\n\nholder, return of the provider fee shall be based upon ninety\n\npercent (90%) of the unearned pro rata provider fee less the actual\n\ncost of any service provided under the service warranty contract.\n\nIn the event the contract is canceled by the association, return of\n\npremium shall be based upon one hundred percent (100%) of unearned\n\npro rata provider fee less the actual cost of any service provided\n\nunder the service warranty contract.\n\nC. Service warranties shall state the name and address of the\n\nservice warranty association and shall identify any administrator if\n\ndifferent from the service warranty association, the service\n\nwarranty seller and the service warranty holder to the extent that\n\nthe name of the service warranty holder has been furnished by the\n\nservice warranty holder. For service warranties issued on and after\n\nJuly 1, 2017, the identity of the service warranty association and\n\nits license number shall be preprinted on the service warranty or\n\nadded at the time of sale so consumers can clearly identify the\n\nobligor of the service warranty. Information to be printed at the\n\ntime of sale shall be indicated as such at the time the service\n\nwarranty is filed and a “Jane Doe” specimen shall accompany the\n\nservice warranty illustrating how the service warranty will look\n\nafter printing.\n\nEach person and service warranty association shall\n\nelectronically submit, in the form and manner prescribed by the\n\nCommissioner, any change of legal business name, “doing business as”\n\nor assumed name, address, or contact email address within thirty\n\n(30) days after the change occurred, and any fees deemed necessary\n\nby the Commissioner. Any submission of a change under this\n\nparagraph received more than thirty (30) days after the change\n\noccurs shall be accompanied by a fee of Fifty Dollars ($50.00).\n\nD. The Commissioner shall have the authority to immediately\n\norder a service warranty association to stop using any service\n\nwarranty contract if the Commissioner determines that the form:\n\n1. Violates the Service Warranty Act;\n\n2. Is misleading in any respect; or\n\n3. Is reproduced so that any material provision is\n\nsubstantially illegible.\n\nE. The Insurance Commissioner may, by order, exempt from the\n\nrequirements of this section for so long as he or she deems proper\n\nany document or form or type thereof as specified in such order, to\n\nwhich, in his or her discretion, this section may not practicably be\n\napplied, or the filing of which is, in his or her opinion, not\n\ndesirable or necessary for the protection of the public.","path":["OK Code","Title 15"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os15.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d24a8914139a3e32fabdf2204d9f1b39bfeb1d37c85fbdfb09fcefb2ec350137","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-15-15-141.13v1","next":"us-ok/okla.-stat.-tit.-15-15-141.14"},"notice":"GroundRules: Original legal text.
