Any person damaged by a violation of the provisions of the\n\nService Warranty Act may bring a civil action against a person\n\nviolating such provisions in the district court of the county in\n\nwhich the alleged violator resides or has its principal place of\n\nbusiness or in the county in which the alleged violation occurred.\n\nUpon adverse adjudication, the defendant shall be liable for actual\n\ndamages or Five Hundred Dollars ($500.00) whichever is greater,\n\ntogether with court costs and reasonable attorney's fees incurred by\n\nthe plaintiff.\n\nB. A service warranty and those contracts specified in\n\nsubparagraphs a through e of paragraph 17 of Section 141.2 of this\n\ntitle shall not be deemed to create a special relationship between\n\nthe parties which would give rise to an action in tort to recover\n\nfor breach of the duty of good faith and fair dealing. This section\n\nshall not be construed to preclude a breach of contract action for\n\nfailure of the parties to comply with the implied duty of good faith\n\nand fair dealing in carrying out their obligations as set forth in\n\nthe service warranty.\n\nC.
