Stat. tit. 15, § 15-141.26","heading":"Unfair methods of competition and unfair or deceptive","body":"acts.\n\nFor purposes of the Service Warranty Act, the following methods,\n\nacts, or practices are defined as unfair methods of competition and\n\nunfair or deceptive acts or practices:\n\n1. MISREPRESENTATION AND FALSE ADVERTISING OF SERVICE\n\nWARRANTIES - Knowingly making, issuing, circulating, or causing to\n\nbe made, issued, or circulated, any estimate, illustration,\n\ncircular, statement, sales presentation, omission, or comparison\n\nwhich:\n\na. misrepresents the benefits, advantages, conditions, or\n\nterms of any service warranty contract,\n\nb. is misleading or is a misrepresentation as to the\n\nfinancial condition of any person,\n\nc. uses any name or title of any contract misrepresenting\n\nthe true nature thereof,\n\nd. is a misrepresentation for the purpose of inducing, or\n\ntending to induce, the lapse, forfeiture, exchange,\n\nconversion, or surrender of any service warranty\n\ncontract, or\n\ne. is false, deceptive or misleading with respect to:\n\n(1) the service warranty association's affiliation\n\nwith a motor vehicle manufacturer,\n\n(2) the service warranty association's possession of\n\ninformation regarding a motor vehicle owner's\n\ncurrent motor vehicle manufacturer's original\n\nequipment warranty,\n\n(3) the expiration of a motor vehicle owner's current\n\nmotor vehicle manufacturer's original equipment\n\nwarranty, or\n\n(4) a requirement that a motor vehicle owner register\n\nfor a new service warranty with such provider in\n\norder to maintain coverage under the motor\n\nvehicle owner's current service warranty or\n\nmanufacturer's original equipment warranty;\n\n2. FALSE INFORMATION AND ADVERTISING GENERALLY - Knowingly\n\nmaking, publishing, disseminating, circulating, or placing before\n\nthe public, or causing, directly or indirectly, to be made,\n\npublished, disseminated, circulated, or placed before the public:\n\na. in a newspaper, magazine, or other publication,\n\nb. in the form of a notice, circular, pamphlet, letter,\n\nor poster,\n\nc. over any radio or television station, or\n\nd. in any other way,\n\nan advertisement, announcement, or statement containing any\n\nassertion, representation, or statement with respect to the business\n\nof service warranty, which assertion, representation, or statement\n\nis untrue, deceptive, or misleading;\n\n3. DEFAMATION - Knowingly making, publishing, disseminating, or\n\ncirculating, directly or indirectly, or aiding, abetting, or\n\nencouraging the making, publishing, disseminating, or circulating\n\nof, any oral or written statement, or any pamphlet, circular,\n\narticle, or literature, which is false or maliciously critical of,\n\nor derogatory to, any person and which is calculated to injure such\n\nperson;\n\n4. FALSE STATEMENTS AND ENTRIES - Knowingly:\n\na. filing with any supervisory or other public official,\n\nb. making, publishing, disseminating, or circulating,\n\nc. delivering to any person,\n\nd. placing before the public, or\n\ne. causing, directly or indirectly, to be made,\n\npublished, disseminated, circulated, delivered to any\n\nperson, or placed before the public, any false\n\nstatement, or\n\nmaking any false entry of a material fact in any book,\n\nreport, or statement of any person;\n\n5. UNFAIR CLAIM SETTLEMENT PRACTICES -\n\na. attempting to settle claims on the basis of an\n\napplication or any other material document which was\n\naltered without notice to, or knowledge or consent of,\n\nthe warranty holder,\n\nb. making a material misrepresentation to the warranty\n\nholder for the purpose and with the intent of\n\neffecting settlement of such claims, loss, or damage\n\nunder such contract on less favorable terms than those\n\nprovided in, and contemplated by, such contract, or\n\nc. committing or performing with such frequency as to\n\nindicate a general business practice any of the\n\nfollowing practices:\n\n(1) failure properly to investigate claims,\n\n(2) misrepresentation of pertinent facts or contract\n\nprovisions relating to coverages at issue,\nlaims, loss, or damage\n\nunder such contract on less favorable terms than those\n\nprovided in, and contemplated by, such contract, or\n\nc. committing or performing with such frequency as to\n\nindicate a general business practice any of the\n\nfollowing practices:\n\n(1) failure properly to investigate claims,\n\n(2) misrepresentation of pertinent facts or contract\n\nprovisions relating to coverages at issue,\n\n(3) failure to acknowledge and act promptly upon\n\ncommunications with respect to claims,\n\n(4) denial of claims without conducting reasonable\n\ninvestigations based upon available information,\n\n(5) failure to affirm or deny coverage of claims upon\n\nwritten request of the warranty holder within a\n\nreasonable time after proof-of-loss statements\n\nhave been completed, or\n\n(6) failure to promptly provide a reasonable\n\nexplanation to the warranty holder of the basis\n\nin the contract in relation to the facts or\n\napplicable law for denial of a claim or for the\n\noffer of a compromise settlement;\n\n6. FAILURE TO MAINTAIN PROCEDURES FOR HANDLING COMPLAINTS -\n\nFailing to maintain a record of each complaint received for a three-\n\nyear period after the date of the receipt of the written complaint;\n\n7. DISCRIMINATORY REFUSAL TO ISSUE A CONTRACT - Refusing to\n\nissue a contract solely because of an individual's race, color,\n\ncreed, marital status, sex, or national origin; and\n\n8. FAILURE TO PROVIDE TERMS AND CONDITIONS PRIOR TO SALE -\n\nFailing to provide a consumer with a complete sample copy of the\n\nterms and conditions of the service warranty prior to the time of\n\nsale upon a request for the same by the consumer. A service\n\nwarranty association may comply with the provisions of this\n\nparagraph by providing the consumer with a sample copy of the terms\n\nand conditions of the warranty contract or by directing the consumer\n\nto a website that displays a complete sample of the terms and\n\nconditions of the contract.","path":["OK Code","Title 15"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os15.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"062d053407a39543c163f2f357fe7af8b26b1bb09b67ff51d36f3625149dd432","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-15-15-141.25","next":"us-ok/okla.-stat.-tit.-15-15-141.27"},"notice":"GroundRules: Original legal text.
